AMENDED COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #235-2007 RESOLUTION APPROVING AMENDMENTS TO THE CITY ADMINISTRATOR'S EXISTING EMPLOYMENT AGREEMENT WHEREAS, the City Administrator's Employment Agreement approved September 27,2005 by Common Council Resolution No. 176-2005 set salary and benefits for two years (October 3, 2005 - October 2, 2006 and October 3, 2006 - October 2, 2007), and WHEREAS, the Common Council desires to amend the City Administrator's Existing Employment Agreement to set salary and benefits for the period beginning January 1, 2008 to December 31, 2008. NOW, THEREFORE, BE IT RESOLVED, the City Administrator's existing Employment Agreement approved by Common Council Resolution No. 176-2005 dated September 27,2005, is hereby amended as follows: Section 3. Term and Review - Add after the first sentence, "The term of the agreement for purposes of benefits and salary is hereby extended to run from January 1,2008 to December 31, 2008." Add following the last sentence of Section 3, "The City Administrator's performance may be reviewed by the Common Council at the discretion of the Common Council at a date of their choosing but prior to the April, 2008 election to ensure the performance review is by the Common Council the City Administrator has worked for and with." Section 4. Salary - Add at the end of this section "The City Administrator's annual salary, effective on January 1, 2008, shall be Eighty-Eight Thousand Five Hundred Twenty ($88,520) dollars, paid on a bi-weekly basis, in the manner in which salaries are paid to other managerial employees of the City." Section 5. Benefits - Under vacation add at the end of the sentence, "and 20 work days the third year." Section 7. Car Allowance - delete the words ".. . currently $.405 per mile." BE IT FURTHER RESOLVED, All other sections/provisions shall remain unchanged. BE IT FURTHER RESOLVED That the Mayor is authorized to sign the Agreement in the name of the City. THIS AGREEMENT, made and entered into this 3rd day of October, 2005, and amended this 27th day of November, 2007 by and between the Common Council of the City of Muskego, Wisconsin, hereinafter referred to as "City", and Jennifer M. Sheiffer, 3603 Briar Crest Drive, Janesville, WI. 53546, hereinafter referred to as "City Administrator". The City Administrator for the City of Muskego is an "at will employee". 1. Employment Subject to the provisions of the Personnel Code and Policy Handbook and provisions herein contained, the Common Council of the City hereby employs Jennifer M. Sheiffer as City Administrator for the City of Muskego, in accordance with the attached job description. 2. Date of Hire The date of hire shall be established as October 3,2005. . 3. Term and Review The term of this agreement for purposes of benefits and salary will be for two years. The term of the agreement for purposes of benefits and salary is hereby extended to run from January 1,2008 to December 31, 2008. The Mayor and Common Council agree to participate in team building and/or goal setting sessions with the City Administrator at least once a year for the purposes of providing general direction for the City Administrator. At such time, the Mayor, Council and City Administrator shall define such goals and performance objectives which they determine necessary for the proper operation of the City. The goals and objectives and their relative priority shall be reduced to writing. The review shall also include, but not by way of limitation, examination and evaluation of the performance of City Administrator and of the compensation and benefits paid by the City to the City Administrator. The City Administrator's performance may be reviewed by the Common Council at the discretion of the Common Council at a date of their choosing, but prior to the April 2008 election to ensure the performance review is by the Common Council the City Administrator has worked for and with. 4.~ The City shall pay the City Administrator as compensation for her services as City Administrator, an annual salary of Eighty- Two Thousand ($82,000) Dollars, effective on October 3,2005, and Eighty-Four Thousand ($84,000) effective on October 3, 2006, paid on a bi-weekly basis, in the manner in which salaries are paid to other managerial employees of the City. The City Administrator's annual salary, effective on January 1, 2008, shall be Eighty-Eight Thousand Five Hundred Twenty ($88,520) dollars paid on a bi-weekly basis in the manner in which salaries are paid to other managerial employees ofthe City. . 5. Benefits The City Administrator shall be entitled to all fringe benefits such as insurances, pension and holidays currently provided to the City's Nonrepresented employees, Agreement - City Administrator Page 2 . and such additional fringe benefits, if any, as the City may grant from time to time, to Nonrepresented employees. The City Administrator shall pay health insurance premiums co-payments and other co-payments under the same terms as all full-time Nonrepresented employees. Vacation The City Administrator shall be entitled to fifteen work days vacation the first year and eighteen work days the second year, and 20 work days the third year. Sick Leave The City Administrator shall accrue sick days at the rate of 10 hours per month. Accumulation of sick leave and payment of sick leave upon termination shall be subject to the policy in the Nonrepresented Personnel Code. 6. Dues, Subscriptions and Conferences The City agrees to budget and pay for professional dues and subscriptions of the City Administrator for her continuation and participation with national, regional, state and local associations and organizations deemed necessary and desirable for her continued professional participation, growth and advancement, and for the good of the City. The City Administrator shall inform the Common Council, as part of the annual budget process, of professional seminars, conferences and meetings which, in her judgment would be of greatest benefit to the City and to her in the discharge of her employment; and the City agrees to give due consideration to such request. . 7. Car Allowance The City shall reimburse the City Administrator for mileage to and from outside professional organization meetings at the adopted IRS mileage rate. 8. Termination of Emplovment The parties agree that the City Administrator may terminate this agreement by giving the City a minimum of forty-five (45) days written notice prior to the City Administrator's final day of employment. The City Administrator's final day of employment shall be defined as the last day of actual work in service to the City. Because this employee is an "at will employee", the City Administrator may be discharged or terminated at any time without reason and without cause by a majority vote of the Council.
