COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #218-2007 A RESOLUTION APPROVING THE PROJECT PLAN FOR TAX INCREMENTAL DISTRICT NUMBER 10 WHEREAS, the portion of the City of Muskego, Waukesha County, Wisconsin (the "City") described on Exhibit A hereto is suitable for mixed-use development, as defined in Section 66.1105(2)(cm) of the Wisconsin Statutes, consisting of a combination of industrial and commercial uses; and WHEREAS, the creation and implementation of a tax incremental district pursuant to Section 66.1105 of the Wisconsin Statutes is necessary in order for such development to occur; and WHEREAS, the City has determined that the promotion of mixed-use development in this area of the City is in the best interest of the City and will benefit the City by promoting public welfare and by increasing the City's tax base and the number of jobs available in the City; and WHEREAS, the City desires to act to promote mixed-use development in the City and obtain these benefits for the City and its residents; and WHEREAS, under the provisions of Section 66.1105 of the Wisconsin Statutes the City has the power to create tax incremental districts for the purpose of promoting mixed-use development in ~ea~a~ . WHEREAS, pursuant to Section 66.1105 of the Wisconsin Statutes the City has caused a project plan for a tax incremental district (the "Project Plan") to be prepared by the Plan Commission; and . WHEREAS, on November 6, 2007, the Plan Commission held a public hearing at which all interested parties were afforded a reasonable opportunity to express their views on the proposed creation of the tax incremental district and the proposed boundaries of the district and the Project Plan, and, following the public hearing, adopted the Project Plan and submitted it to this Common Council; and WHEREAS, the Project Plan includes (a) a statement listing the kind, number and location of all proposed public works or improvements within the tax incremental district; (b) an economic feasibility study; (c) a det~iled list of estimated project costs; (d) a description of the methods of financing all estimated project costs and the time when the costs or monetary obligations related thereto are to be incurred; (e) a map showing existing uses and conditions of real property in the district; (f) a map showing proposed improvements and uses in the district; (g) proposed changes in zoning ordinances, the City's master plan, map, building codes or ordinances; (h) a list of estimated nonproject costs; (i) a statement of the proposed method for the relocation of any persons being displaced; G) a statement indicating how creation of the district promotes orderly development of the City and (k) a legal opinion advising that the Project Plan is complete and complies with Section 66.1105 of the Wisconsin Statutes; and WHEREAS, the Project Plan has been presented to and reviewed by this Common Council; and WHEREAS, the Project Plan will promote mixed-use development in the City; . . . Reso. #218-2007 Page 2 NOW, THEREFORE, be it resolved by the Common Council of the City of Muskego, Waukesha County, Wisconsin, that: Section 1. Feasibility of Proiect Plan. Based on the information set forth in the Project Plan, including the economic feasibility report which is a part of the Plan, this Common Council finds that the Project Plan is feasible. Section 2. Conformity with Master Plan. The Project Plan is in conformity with the master plan of the City. Section 3. Approval of Proiect Plan. The Project Plan for the proposed Tax Incremental District Number 10 of the City of Muskego is approved pursuant to Section 66.1105(4)(g) of the Wisconsin Statutes.
