PCR2008082 ./PCR2008082_files/filelist.xml RESOLUTION #PC 082-2008 Print BestFit RESOLUTION #P.C. 082-2008 APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR BUSH GARDENS LOCATED IN THE SW ¼ OF SECTION 2 (S68 W14891 JANESVILLE ROAD / TAX KEY NO. 2167.998.002)   WHEREAS, On November 17, 2008 a submittal was received for Bush Gardens located at S68 W14891 Janesville Road (Former Atonement Lutheran Church property / Tax Key No. 2167.998.002), and   WHEREAS, As stated above, the petitioner requests approvals to update the current Atonement Lutheran Church property/structure according to the Historic Crossroads zoning and design guide principles, similar to the existing Bushy’s Pub and Grill structure to the east, and   WHEREAS The proposal is to update the current Atonement Lutheran Church property into what is to be called Bush Gardens, a multi-functional facility for various meetings events meeting events (banquets, business meetings/seminars, conferences, weddings, receptions, funeral luncheons, dinners, holiday gatherings, celebrations, music performances, recitals, and comedy events, etc.), and   WHEREAS, An extensive submittal is included in the supplement consisting of a narrative, site plan, plat of survey, grading plan, future build out plan, floor plan, landscape plan, stormwater plan, utility plan, building elevations, colored renderings, site lighting plan, and a photometric plan, and   WHEREAS, The current facility has two floor levels with the main floor at approx. 10,970 sq. ft. and the partial lower level at 2,800 sq ft., totaling 13,770 sq. ft., and   WHEREAS, The primary floor area for dining and the main assembly hall is a total of 4,335 SF that will be used for the Bush Gardens operations, meetings, weddings, banquets, etc. (Bar/Dining at 1,773 SF plus Hall at 2,582 SF = 4,335 SF) and the remaining area will include lobby, toilets, mechanical equipment, an office, kitchen, etc., and   WHEREAS, The total enclosed Bush Gardens building will be approximately 11,198 SF after remodeling and this is approximately 23% smaller than the current size as the eastern most portion of the structure will be removed, and   WHEREAS, The main floor area will be a gross area of 8,398 SF and the lower level remains at 2,800 SF and the lower level will be used mostly for food and beverage storage, linens, mechanical equipment, toilets, support functions, etc., and   WHEREAS, The proposal follows the business uses found in the 2010 Plan and follows the HC-1 Historic Crossroads District zoning existing on this property, and   WHEREAS, The building is planned to remain the same size and height, but will receive extensive modifications to adapt to the Arts and Crafts/Garden Style architectural requirements of the HC-1 zoning district.  All sides of the facility are to be remodeled per below:   1.       New dimensional shingles matching Bushy’ Pub and grill are to be added throughout. 2.       Most of the existing brick and stonewalls are to remain. Some may be removed for new windows.  About 57% of the exterior is masonry. 3.       All vinyl and wood siding will be removed and replace with Hardi-Plank. 4.       Existing Stucco and EIFS will be replaced with Hardi-Plank. 5.       Wood trim and soffits will be re-stained consistent with Bushy’s Pub and Grill quality and appearance. 6.       Window muntin bars are to be installed on the new and existing windows to refine appearance with the historical zoning, and   WHEREAS, the updates to the facades are as follows: 1.       West Elevation: The west elevation is to receive some of the most extensive and pleasing updates compared to what currently exists on the existing structure.   Someone traveling down Janesville Road to the east should see a noticeable difference. The West elevation is planned to be softened to become more inviting and architecturally compatible with the other elevations by adding a covered balcony with wrought iron railing to match other railings. New gables, soffits, brick, and shake siding also compliment this façade. 2.       East elevation: Fully remodeled now that this side of the building is now to be removed. Siding fully updated (shake and hardi-plank), addition of masonry brick, new doors/windows. 3.       North elevation: New outdoor terrace to be added with new windows, siding, and gables. Architectural elements under the soffits, grid pattern in windows, and wrought iron ornamental railing under the windows. 4.       South elevation: New entrance updated with new windows, siding, and gables. Secondary entrance (Garden Terrace) with awning added, and   WHEREAS, Colors on the structure will compliment the Bushy’s Pub and Grill building to the east and all colors are of earth tones, and   WHEREAS, The property is within the Historic Crossroads Deign Guide area and is also governed by the General Design Guide and the following has been taken into consideration to meet both these guidelines: 1.       All aspects meet the general requirements of the HC-1 zoning (setbacks, offsets, heights, etc.). 2.       Relationship of building to site: parking is mostly shielding parking lot; building/site being remodeled to be compatible with existing adjacent buildings/sites. 3.       Building Design: Four sided architecture converts existing 60’s style church to a mix of Garden Arts and Crafts architecture with elements of colonial revival and bungalow style. 4.       Materials: Commercial grade materials used; existing materials upgraded. 5.       Colors: Harmonious with neighborhood buildings. 6.       Accessory structures: removing lawn maintenance shed, no accessory structure planned; refuse containers enclosed. 7.       Screening devices: All mechanical and electrical equipment to be screened with complimenting architecture. 8.       Parking, landscaping, lighting: All upgraded and comply with design guides, and   WHEREAS, The submittal shows a total of 195 parking stalls, which meets the City of Muskego ordinance for parking per below:   Bushy’s Pub and Grill: (3,000 sq. ft. of dining space) = 60 spaces (1 space for every 100 SF) Bush Gardens Room Seating Dining/Bar at (1,773 SF of space) = 35 spaces (1 space for every 200 sq. ft.) Assembly hall Area (156 people) = 52 spaces (1 space for every 3 people) Office  = 1 space 47 Extra spaces for future build out, and   WHEREAS, Appropriate access is found throughout the site with multiple shared entrances, appropriate markings, and appropriate access lane widths, and   WHEREAS, New parking stalls have been added to the western portion of the site and a small row on the eastern portion of the Bushy’s Pub and Grill property, and   WHEREAS, Curbing is to be added to all the parking and retaining walls are required due to some re-grading on the lot to accommodate the parking, and   WHEREAS, The Fire Department has reviewed the new plan and approves as a Fire Street is found along the main southern façade of the structure per code, and   WHEREAS, The majority of the event rooms are anticipated to be used upon reservation and for scheduled events during all times of day (breakfast, lunch, dinner), hours will vary, but will be consistent with Bushy’s Pub and Grill of 11 AM to close (Note: Liquor permit required from Finance Committee), and   WHEREAS, A current and proposed landscape plan are part of the submittal and are under review by the City Forester and the new plan shows a quality update to the existing landscaping and compliments the building architecture well, and   WHEREAS, The parking lot has extensive landscaping as all the parking stalls are broken up with landscape islands and the perimeter of the building shows ample landscaping with more intense landscaping along the terrace area, which should help with any future noise or site issues that may derive from this use, and   WHEREAS, The developers submitted an updated landscape plan, which shows considerable landscaping at the back of the new southern curb and this line of trees should help well with protecting the noise and lights from this parking lot that wasn’t protected with the prior church use, and   WHEREAS, Signage modifications are shown to take place on the existing monument sign, as wall signage on the northern façade (externally lit), as wall signage on the southern façade, on the canopy proposed on the southern façade, and as a replacement of the existing information marquee on the southern facade, and   WHEREAS, A lighting and photometric plan is found in the submittal and approximately 15 new high pressure sodium pole lights are to be added in the newly updated parking lot and all proposed lights meet the City’s design guide requirements of 0.5 foot-candles at the property lines, and   WHEREAS, A few pole lights, mimicking those found on the Bushy’s Pub and Grill site, are found along the southern portion of the parking lot and all lights will have to meet the City’s design guide requirements of a max. 6-inch concrete base, and   WHEREAS, An existing refuse enclosure exists as part of the Bushy’s Pub and Grill site and will be used for the refuse needs of Bush Gardens, and   WHEREAS, The site is serviced by public water and sewer, and WHEREAS, There is an intention to add a future building for office/retail and residential occupancy and a future BSO approval would be required for this to ensure the HC-1 principles are being met along with the appropriate parking, landscaping, and stormwater requirements, and   WHEREAS, The BSO petition is within the Redevelopment District #1,which promotes the usage of the Historic Crossroads Design Guide for new improvements and Community Development Authority review and recommendation is required, and   WHEREAS, The Community Development Authority recommended approval as submitted on December 1, 2008.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and Operation Plan for Bush Gardens located at S68 W14891 Janesville Road (Former Atonement Lutheran Church property / Tax Key No. 2167.998.002).   BE IT FURTHER RESOLVED, That an annual review will be held yearly in conjunction with the existing Bushy’s annual review to review any changes needed for this approved BSO in relation to any nuisances that may come about (noise, lights, etc.)   BE IT FURTHER RESOLVED, That the hours of operation are subject to the review of the Finance Committee and the liquor license determination.   BE IT FURTHER RESOLVED, The landscape plan is subject to City Forester approval before the release of building permits and the landscape plan will have to address the southern landscape screening per the requirements of the Planning Department.   BE IT FURTHER RESOLVED, That all engineering related plans including the sewer, water, and stormwater plans are subject to City Engineer approval before the issuance of any building permits.   BE IT FURTHER RESOLVED, All proposed signage will require formal permits with the Planning and Building Departments at the time of building permits to determine size allowances.   BE IT FURTHER RESOLVED, The existing ingress/egress agreement shall be amended and recorded to include that parking stalls are shared via these two properties in perpetuity as well as before building permit issuance.   BE IT FURTHER RESOLVED, All lights will have to meet the City’s design guide requirements of a max. 6-inch concrete base.   BE IT FURTHER RESOLVED, That all roof top and ground mechanicals (including HVAC devices, electrical transformers, etc.) shall be screened from view and/or incorporated into the design of the site/structure (screening, etc.) and should be approved by the Planning Department.   BE IT FURTHER RESOLVED, That any bollards must be painted to match the colors of the principal structure.   BE IT FURTHER RESOLVED, That all handicap signs be incorporated into bored bollards.   BE IT FURTHER RESOLVED, That no outdoor storage of any type is allowed on the site including, but not limited to, dumpsters, pallets, supplies, materials, and racking.   BE IT FURTHER RESOLVED, That a future building would need a future BSO approval to ensure the HC-1 principles are being met along with the appropriate parking, landscaping, and stormwater requirements.   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of
