PCR2008077 PCR2008077_filelist.xml RESOLUTION #PC 077-2008 Print BestFit RESOLUTION #P.C. 077-2008 APPROVAL OF A METAL ACCESSORY STRUCTURE FOR THE TRUETT PROPERTY LOCATED IN THE NE ¼ OF SECTION 13 (TAX KEY NO. 2209.960 / S81 W12469 HI VIEW DRIVE) WHEREAS, On August 15, 2008 a site plan and building drawings were submitted by Tony Truett to construct a 2,080 square foot metal accessory structure on the property located at S81 W12469 Hi View Drive, and WHEREAS, The property is zoned RCE, Country Estate District, and where said structure is a permitted accessory use and subject to Plan Commission review due to the proposed architectural materials shown, and WHEREAS, The only existing structure on the property is a home residence, and WHEREAS, The total allowed square footage for accessory structures on this property is limited to 2,291 square feet, and said proposal meets the bulk requirements of the Zoning Code, and WHEREAS, The proposed 2,080 square foot accessory structures is within the allowed limit, and WHEREAS, The front elevation of the structure is proposed to be constructed with hardiplank cedarmill siding ivory in color to match the color and texture of the home and the side and rear walls will be ivory colored steel walls, pinewood colored trim, and a steel roof that matches the color of the asphalt shingles on the house, and said proposal does not meet the Plan Commission’s standards for administrative approval of residential accessory structures as the siding and roof does not match the materials used on the primary residence, and WHEREAS, The accessory structure will have 12 inch overhangs to match the house, and WHEREAS, The structure is located about 125 feet from the front lot line and 25 feet from the side lot line, and WHEREAS, The proposed height to the mid point of the gable (as measured by code) is approximately 18 feet, which is within the maximum height allowed by the code of 22.4 feet (as measured by code), and WHEREAS, A landscape plan has seen submitted showing that additional landscaping will be added on the north and east sides of the building to help further screen the building. THEREFORE BE IT RESOLVED, That the Plan Commission approves a 2,080 square foot metal accessory structure submitted by Tony Truett for the property located at S81 W12469 Hi View Drive. BE IT FURTHER RESOLVED, That the building cannot be used for the operations of a business since the property has a single-family residential zoning upon it. BE IT FURTHER RESOLVED, That all floors of the accessory structure must be asphalt, sealed concrete block, or concrete slab per the Zoning Code and it must meet all applicable building codes. BE IT FURTHER RESOLVED, That the colors of the new accessory structure must match the colors of the house. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
