COMPLAINT REGARDING THE
"CLASS B" RETAILERS' LICENSE FOR THE SALE OF FERMENTED MALT
BEVERAGES AND INTOXICATING LIQUORS OF RICHARD LUCHT, DIBIAI THE
LAKEVIEW TAVERN
WHEREAS, the City of Muskego received an amended Complaint against Richard
Lucht, D/B/AI The Lakeview Tavern on July 19, 2007; and
WHEREAS, the Finance Committee has recommended the issuance of a summons
pursuant to Wisconsin Statutes to command the appearance of the licensee at a
hearing to be held before the Common Council to determine if the "Class B" Retailers'
License for the Sale Of Fermented Malt Beverages and Intoxicating Liquors should be
revoked or suspended.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby authorize
the Clerk at an appropriate time before hearing to issue a summons as to complaint
received regarding the "Class B" Retailers' License for the Sale of Fermented Malt
Beverages and Intoxicating Liquors of Richard Lucht, D/B/AI The Lakeview Tavern
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Finance Committee, does hereby
authorize the Mayor to set a hearing date.

Upon the filing of the Complaint, a copy of which is attached hereto, the Common Council of the
City of Muskego authorized the issuance of this Summons and you are hereby commanded to
appear before the Common Council of the City of Muskego at a time and date fixed by the Mayor
pursuant to Resolution # 150-2007 attached hereto at the Muskego City Hall, W182 S8200 Racine
Avenue, Muskego, Wisconsin and show cause why your license should not be revoked and/or
suspended based upon the Complaint attached hereto, said time and date being fixed as the ~
day of ~, 2007 at -+ PM.
If you do not appear as required by this Summons, the allegations of the complaint shall be taken
as true, and if the Common Council of the City of Muskego finds the allegations sufficient, the
license shall be revoked.
. If you appear as required by the Summons and deny the Complaint, both the complainant and
you, the license holder, may produce witnesses and cross-examine witnesses under oath and
be represented by counsel.
The hearing will be transcribed in writing and you have a right to a written transcript of the
hearing at your expense.
TO: Muskego Police Department: You are hereby directed to serve this Summons and attached
Complaint upon Richard lucht, D/B/AI The lakeview Tavern. The Summons shall command the
licensee complained of to appear before the municipal governing body on a day and place named
in the Summons, not less than 3 days and not more than 10 days from the date of issuance. The
Summons and a copy of the Complaint shall be served on the licensee at least 3 days before the
time at which the licensee is commanded to appear. Service shall be in the manner provided under
Chapter 801 for service in civil actions in circuit court. ~

AMENDED COMPLAINT TO THE CITY OF MUSKEGO.
WAUKESHA COUNTY. WISCONSIN.
AGAINST RICHARD LUCHT. DfB/AI THELAKEVIEW TAVERN
The complainant, Captain John Z. La Tour, a police officer for the City of Muskego
Police Department, hereinafter referred to as complainant, for a complaint against
Richard Lucht, D/B/ AJ The Lakeview Tavern, hereinafter referred to as licensee,
pursuant to Wisconsin Statutes l25.07(1)(a)(2), and Muskego Ordinance 12.01, having
first been duly sworn on oath alleges on information and belief as follows:
1. Complainant is the Operations Division Commander for the City of Muskego and a
resident of the City of Muskego. The Lakeview Tavern of Muskego is a "Class B"
licensed establishment for the sale of fermented malt beverages and intoxicating liquors
located at W171 S7260 Lannon Drive in the City of Muskego, Waukesha County,
Wisconsin, and its sole-proprietor is Richard Lucht, and said person holds alcohol
beverage licenses as set forth attached Exhibit No.1, which is incorporated herein in
reference.

2. On August 29,2006, two twenty year old persons entered the "Class B" licensed
establishment., D/B/A The Lakeview Tavern at W171 S7260 Lannon Drive, in the City of
Muskego, Waukesha County, Wisconsin, and ordered and was sold two twelve ounce
bottles of beer, to wit: an alcohol beverage within the meaning of Wisconsin Statutes,
Section 125.07(1)(a)(2), by one Lynda L. Kisting, the bartender working on the premises.
3. On March 5, 2007, a twenty year old person and a nineteen year old person entered
the "Class B" licensed establishment, D/B/A The Lakeview Tavern at Wl71 S7260
Lannon Drive, in the City of Muskego, Waukesha County, Wisconsin, and ordered and
was sold two twelve ounce bottles of beer, to wit: an alcohol beverage within the meaning
of Wisconsin Statutes, Section 125.07(1)(a)(2), by one Maria L. Sosa, the bartender
working on the premises.
4. Each of the above stated incidents violates Wisconsin Statutes, Section 125.07, and
Muskego Ordinance Number 12.01.
5. On each occasion the bartender working on the premises was convicted of selling
alcohol beverages, to wit: fermented malt beverages, to underage persons in violation of
the aforementioned statutes and ordinances

6. Complainant believes the information contained in this complaint is reliable because
as to each violation complainant was, as the Captain of Police, the command officer
directing the police investigation, knows the police officers who observed the violations to
be truthful and reliable, and each municipal citation issued in conjunction with said
violations was based upon the personal observation of the officers who issued the charge.
Further, complainant has reviewed the police reports and other records ofthe City of
Muskego, believes them to be reliable, and has found them to consistently be reliable in
the past.

Complainant requests that a Summons issue, that a Hearing be scheduled and held before
the Common Council of the City of Muskego, and that the alcohol beverage license held
by Richard Lucht, D/B/A The Lakeview Tavern for the premise located at WIn Sn60
Lannon Drive, in the City of Muskego, Waukesha County, Wisconsin, be suspended or
revoked, all pursuant to Wisconsin Statutes Section 125.12 and the relevant ordinances of
the City of Muskego.
