RECOMMENDATION TO COUNCIL TO REZONE A PORTION OF A PROPERTY FROM RS-1 SUBURBAN RESIDENCE DISRICT TO BP-1 BUSINESS AND OFFICE PARK SUPPORT DISTRICT AND A PORTION OF A PROPERTY FROM
B-3 GENERAL BUSINESS DISTRICT TO BP-1 BUSINESS AND OFFICE PARK SUPPORT LOCATED IN THE NE ¼ OF SECTION 3 (PORTION OF TAX KEY NO. 2169.999.001 / MOORLAND ROAD)
WHEREAS, A petition for rezoning was submitted by George Erwin to rezone a portion of a property from RS-1 Suburban Residence District to BP-1 Business and Office Park Support District
AND a portion of a property from B-3 General Business District to BP-1 Business and Office Park Support District to allow for future commercial uses, and
WHEREAS, The property is located along the east side of Moorland Road within the recently approved Tax Incremental District (TID) #10, and
WHEREAS, A public hearing is scheduled before the Common Council on August 12th, 2008, and
WHEREAS, No user of the property is noted at this time by the petitioner, however, the developer has noted that they are setting the stage for the marketing of this property to commercial
entities relating to retail, and
WHEREAS, The City of Muskego setup business park zoning around this area a few years ago in order to promote a business corridor once Moorland Road was improved into New Berlin, and
WHEREAS, The City has most recently adopted a Tax Incremental District in which sewer and water infrastructure will be built to this area during the summer of 2008. Further, Moorland
Road will be converted to four lanes and become more of a gateway into the community with landscaping, signage, and lighting, and
WHEREAS, The TID #10 Project Plan was approved with the notion that commercial uses would drive the east side of Moorland Road and this rezoning request is consistent with those notions,
and
WHEREAS, Public sewer and water will serve the property as part of the TIF #10 improvements to be constructed during 2008, and
WHEREAS, The 2010 Comprehensive Plan depicts the property for Business Park supporting a mix of commercial and business uses along with a portion of the property as Low Density Residential
Uses (northeast corner of property) and a 2010 Plan Amendment is required from this Low Density Residential portion of the property to Business Park Uses.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning of a portion of a property from RS-1 Suburban Residence District
to BP-1 Business and Office Park Support District AND a portion of a property from B-3 General Business District to BP-1 Business and Office Park Support District the property known
as Tax Key No. 2169.999.001, as submitted by George Erwin.
BE IT FURTHER RESOLVED, That approval for the 2010 amendment from Low Density residential to business Park is part of this resolution.
BE IT FURTHER RESOLVED, That any future commercial use on the property will require a Building, Site, and Operation Plan approval in front of the City’s Planning Commission.
