COMMON COUNCIL - CITY OF MUSKEGO
RESOLUTION #123-2007
RESOLUTION TO TERMINATE THE RELOCATION ORDER
ISSUED BY ACTION ON RESOLUTION #210-2006
WHEREAS, The Common Council of the City of Muskego adopted Resolution #210- 2006 on November 28, 2006, which issued a relocation order in accordance with
Wisconsin State Statute 32.05 (1) for property as indicated on Exhibit "An and Exhibit "B"; and
WHEREAS, The Common Council has now determined there is no immediate public
interest that exists that is not similar to other structures along the Pilak Creek; and
WHEREAS, The Common Council has now determined that storm sewer watercourse
control improvements are not unique and immediately necessary in the public interest
along Pilak Creek.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego hereby withdraws, cancels and terminates the relocation order issued by
action taken on Resolution #210-2006.

That part of the Southwest One-quarter (1/4) of Section Nine (9), Township Five (5)
North, Range Twenty (20) East, in the City of Muskego, Waukesha County, Wisc09nsin,
described as follows: Beginning in the center line of the Janesville Plank Road at the
West side of the outlet of Little Muskego Lake running thence in a Southeasterly
direction along the West side of the outlet of Little Muskego Lake to the center of a creek
which enters the outlet from a Westerly direction which is the place of beginning; Thence
continuing in a Southerly direction along the West side of the outlet of Little Muskego
Lake a distance of 145 feet to a point; thence continuing in a Southwesterly direction on a
line with the back line of lots a distance of 62 feet to a point; thence continuing in a
Northwesterly direction a distance of 159 feet to a point which is in the center of a creek
and 59 feet Southwest of the place of beginning; thence continuing in a Northeasterly
direction along the center of the creek to the West side of the outlet of Little Muskego
Lake a distance of 59 feet which is the place of beginning. Together with a perpetual
easement for ingress and egress over property North of the above described premises and
North of the creek and over the bridge as shown in Land Contract recorded as Document
No. 368252. (See Attached Exhibit "A")
