RECOMMENDATION TO REZONE PROPERTIES FROM EA/OWP EXCLUSIVE AGRICULTURE DISTRICT WITH A WELLHEAD PROTECTION OVERLAY TO PD PLANNED DEVELOPMENT DISTRICT LOCATED IN THE NE ¼ OF SECTION
17 (TAX KEY NOS. 2185.998, 2190.995, & 2190.996 / FIELD DRIVE).
WHEREAS, On June 24, 2008 a petition for rezoning was submitted by Carity Land Corp. to rezone properties from EA/OWP Exclusive Agriculture District with a Wellhead Protection Overlay
to PD Planned Development located on Field Drive (Tax Key Nos. 2185.998, 2190.995 and 2190.996), and
WHEREAS, A Public Hearing for the rezoning has been scheduled before the Common Council on July 22, 2008, and
WHEREAS, The PD Planned Development Overlay District allows flexibility in the underlying zoning in relation to reduced densities, lot sizes, open spaces, height of structures, and/or
setbacks and offsets, and
WHEREAS, The petitioner is requesting the PD Planned Development District using the RC-3 District as a base (consistent with 40,000 square foot lots or greater) for the purpose of
a future subdivision that minimizes wetland intrusion and preserves areas of mature woods and tree lines and to allow flexibility to create preservation easements over the most significant
environmental features on the petitioner’s farm, and
WHEREAS, The petition would permit privately sewered residential development allowing single-family residential lots of a minimum of 40,000 square feet and 150 feet in width and the
future concept plat shows no parcels less than 40,000 square feet and 150 feet in width, and
WHEREAS, The RC-3 zoning allows front setbacks of 40 feet and offsets of 20 feet on all other sides, and
WHEREAS, The yield plan shows that 18 lots might be found under 2.75 acre densities with minimum average widths of 300 feet consistent with the A Agricultural Zoning District, and
WHEREAS, The concept plat shows the average parcel size is approximately 1.7 acres in size with 18 lots, and
WHEREAS, The developers have been in front of the Conservation Commission and the Commission recommended further improvements to the concept plan in the event a rezoning was approved,
and
WHEREAS, The 2010 Comprehensive Plan currently depicts the property for rural-density residential uses (<.49 units an acre), and this proposal is consistent with this goal (Future
plans show a gross of .32 units an acre).
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for the rezoning from the EA/OWP Exclusive Agriculture District with a Wellhead
Protection Overlay to PD Planned Development located on Field Drive (Tax Key Nos. 2185.998, 2190.995 and 2190.996).
BE IT FURTHER RESOLVED, That the provisions set forth by the Conservation Commission must be found in a future preliminary plat for the area.
BE IT FURTHER RESOLVED, That a future preliminary plat must adhere to the concept presented at the rezoning.
