APPROVAL OF BUILDING SITE AND OPERATION PLAN AMENDMENT AND CONDITIONAL USE GRANT AMENDMENT FOR CANINE INVESTMENTS LLC
LOCATED IN THE NW ¼ OF SECTION 16
(S81 W18460 GEMINI DRIVE / TAX KEY NO. 2222.984.003)
WHEREAS, Plans were submitted on June 3, 2008 by Canine Investments LLC for a Building, Site and Operation Plan amendment and Conditional Use Grant amendment for Central Bark Doggy
Day Care at the property located in the Muskego Industrial Park in the NW ¼ of Section 16 (S81 W18460 Gemini Drive / Tax Key No. 2222.984.003), and
WHEREAS, This facility and approval was formerly for Release the Hounds Doggy Day Care which recently closed down and now is going to be re-opened under new ownership as Central Bark
Doggy Day Care, and
WHEREAS, Said property is currently zoned I-1 Industrial Park District, and said use is already allowed and approved through a conditional use grant for animal kenneling, and
WHEREAS, The proposal appears to conform to the bulk requirements of the zoning district, and
WHEREAS, The only change that is being proposed as part of this request is the increase in the number of allowed dogs from forty (40) dogs to sixty (60) dogs, and
WHEREAS, A conditional use grant amendment has been applied for the increased use of animal kenneling within the I-1 Industrial Park zoning district and a public hearing was heard
before the Planning Commission on July 15, 2008, and
WHEREAS, The petitioner is proposing to re-open this doggy day care that provides similar services as previously approved such as: spacious indoor/outdoor play areas, in-house services
for dog bathing, grooming, etc., retail area for dog foods and accessories, and overnight/weekend stay accommodations (Kenneling), and
WHEREAS, There is an existing outdoor fenced in area for outdoor exercise for the dogs, and
WHEREAS, Ample parking exists for employees and for customers consisting of 38 stalls found throughout site, and
WHEREAS, No signage, lighting, or building modification (painting, etc.) details have been provided at this time but the petitioner has noted that they may intend on adding/changing
some of the noted items, and all signage, lighting, and building/site alterations must be approved by staff or, where complications exist, Plan Commission prior to any installation,
and
WHEREAS, Said parcel will be serviced by municipal sanitary sewer and municipal water, and
WHEREAS, The previous approval currently requires an annual review and said review will still be a condition of this amendment, and
WHEREAS, All previous conditions of past approvals still apply with the exception of the increase in the allowed number of dogs to sixty (60).
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and Operation Plan amendment and Conditional Use Grant amendment for Central Bark Doggy Day Care
at the property located in the Muskego Industrial Park in the NW ¼ of Section 16 (S81 W18460 Gemini Drive / Tax Key No. 2222.984.003).
BE IT FURTHER RESOLVED, That the property is limited to no more than sixty (60) dogs on site at any one time, and
BE IT FURTHER RESOLVED, Any signage, lighting, and building/site alterations must be approved by staff or, where complications exist, Plan Commission prior to any installation.
BE IT FURTHER RESOLVED, That the Plan Commission recommends to the property owner to have the building modified to reflect modern building design (50% masonry) when the building is
leased out in full as the building is on a prime highway in Muskego and updates are necessary if possible.
BE IT FURTHER RESOLVED, That a yearly review be held no later than the second meeting in March of every calendar year.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan shall be maintained in perpetuity unless otherwise authorized
by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
