PCR2008061 ./PCR2008061_files/filelist.xml RESOLUTION #PC 061-2008 Print BestFit RESOLUTION #P.C. 061-2008 APPROVAL OF A BUILDING SITE AND OPERATION PLAN AMENDMENT FOR KIDS KAMPUS DAYCARE LOCATED IN THE SW ¼ OF SECTION 16 (S84 W18473 ENTERPRISE DRIVE / TAX KEY NO. 2223.994.005)   WHEREAS, On June 30, 2008 a submittal was received from Kids Kampus Daycare located in the SW ¼ of Section 16 (S84 W18473 Enterprise Drive / Tax Key No. 2223.994.005), and   WHEREAS, The current site is well maintained and consists of one main structure along with parking facilities and a small existing storage shed, and   WHEREAS, The proposal is to add a 1,050 square foot accessory structure for daycare equipment and material storage, and   WHEREAS, The elevations of the existing building on site mostly contain siding material with a band of brick/block towards the bottom of the wall, and   WHEREAS, The structure proposed closely mimics the architecture and colors found on the existing structure on the site and Plan Commission has traditionally allowed new structures to have decreased architectural elements when they are keeping the site consistent, and   WHERERAS, Since there is a band of brick/block on the bottom of the existing main building, the proposed accessory structure should also contain a matching brick/block band on the front elevation, and   WHEREAS, The building is proposed to be 13 feet away from the side lot line, but the code regulations for this zoning district require 15 feet away from a lot line, and   WHEREAS, There are currently two garbage/dumpster bins that are unscreened along with a boat on site, and   WHEREAS, No lighting, signage, or other site/building changes are proposed at this time, and   WHEREAS, The site is serviced by public water and sewer, and WHEREAS, The proposal follows the industrial uses found in the 2010 Plan and the M-2 zoning.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and Operation Plan amendment submitted by Kids Kampus Daycare for an accessory structure located in the SW ¼ of Section 16 (S84 W18473 Enterprise Drive / Tax Key No. 2223.994.005).   BE IT FURTHER RESOLVED, That revised plans need to be submitted for staff review that show a brick/block band matching the existing building added to the front elevation of the accessory structure.   BE IT FURTHER RESOLVED, That the colors and materials of the new accessory structure must match the material and colors of the existing main building.   BE IT FURTHER RESOLVED, That the building must be located at least 15 feet away from the side lot line.   BE IT FURTHER RESOLVED, That any signage or lighting changes/additions must receive approvals from the Planning Department and/or the Plan Commission.   BE IT FURTHER RESOLVED, That no outdoor storage is allowed on site as all storage must be housed inside buildings or the adequate application of screening devices must be sought thru the Planning Department.  This does not apply to toys and equipment directly related to the daycare within the fenced play areas.   BE IT FURTHER RESOLVED, That all garbage/dumpster bins must be screened/enclosed with a solid wood type fence and the design details and location of the enclosure must be submitted before building permits can be issued.   BE IT FURTHER RESOLVED, That since there is floodplain at the rear of this property, more survey and/or elevation details may be required when the building permit is submitted for to ensure that any regulation for areas near a floodplain are being met.   BE IT FURTHER RESOLVED, That details need to be provided before building permits can be issued regarding what is going to happen to the existing shed on the property once the new accessory structure is built.   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.   Plan Commission City of Muskego   Adopted:   July 15, 2008 Denied: Deferred:     Introduced: July 15, 2008  ATTEST:  Kellie McMullen, Recording Secretary
