APPROVAL OF A BUILDING SITE AND OPERATION PLAN AMENDMENT FOR
EM CORPORATION LOCATED IN THE SE ¼ OF SECTION 17
(S82 W19339 APOLLO DRIVE / TAX KEY NOS. 2228.999.020 & 2228.999.021)
WHEREAS, On May 27, 2008 a submittal was received for EM Corporation located at S82 W19339 Apollo Drive (Tax Key Nos. 2228.999.020 & 2228.999.021), and
WHEREAS, The proposal is to install a 1,500 gallon fuel tank off of the southwest corner of the existing building on the property, and
WHEREAS, The tank has two internal compartments with one holding diesel fuel and the other holding unleaded fuel, and
WHEREAS, The tank will be four (4) feet in diameter with a length of 15.8 feet, and
WHEREAS, The proposal follows the industrial uses found in the 2010 Plan and follows the M-2 zoning existing on this property, and
WHEREAS, The tank will be installed per state regulation (COMM 10), which involves state permits and inspections by appropriate state agencies, and
WHEREAS, The tank will be located approximately 380 feet from Apollo Drive, 25 feet from the existing building, and 157 feet from the western lot line, and
WHEREAS, The tank will be enclosed by a 6 foot tall chain link fence and there will be non-flammable slatting placed on the southwest and northwest sides of the fence, and
WHEREAS, These two sides of the fence face the road to the north and the residences to the west and the slats will be green or cream to match the building, and
WHEREAS, The northeast and southeast sides of the fence will not have slatting due to requirements that a portion of the fencing remain unobstructed for fire protection, and
WHEREAS, There also will be crash post/bollards placed around the perimeter of the tank that must be painted to match the color of the building, and
WHEREAS, The Fire Department has looked at the plans and they do not have any issues at this time, and
WHEREAS, No other site changes are proposed at this time.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and Operation Plan amendment submitted for EM Corporation for the installation of a fuel tank located
at S82 W19339 Apollo Drive (Tax Key Nos. 2228.999.020 & 2228.999.021).
BE IT FURTHER RESOLVED, That the slats must be green or cream to match the building.
BE IT FURTHER RESOLVED, The bollards must be painted to match the color of the building.
BE IT FURTHER RESOLVED, That no other site changes are approved at this time and any further changes/additions will require Plan Commission approval.
BE IT FURTHER RESOLVED, That once the tank, fencing, and bollards are all installed and complete, the Planning Department must be contacted to do an inspection before the tank should
be used.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized
by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
