PCR2008054 ./PCR2008054_files/filelist.xml RESOLUTION #P.C. 054-2008 Print BestFit 6 pt 6 pt 0 RESOLUTION #P.C. 054-2008 APPROVAL OF AN AMENDMENT TO A BUILDING SITE AND OPERATION PLAN FOR TUDOR OAKS RETIREMENT COMMUNITY LOCATED IN THE SW ¼ AND SE ¼ OF SECTION 12 (TAX KEY NOS. 2207.999 & 2207.999.002 / S77 W12929 MCSHANE DRIVE)   WHEREAS, On May 19, 2008 plans were submitted by John Marek for an amended Building, Site and Operation Plan for Tudor Oaks Retirement Community located in the SE ¼ and SW ¼ of Section 12 (Tax Key Nos. 2207.999 & 2207.999.002 / S77 W12929 McShane Drive), and   WHEREAS, The facility was built in the 1970’s and has aged over time and now the owners realize that there is a need to update the facility to make it state-of-the-art, and   WHEREAS, Planning Commission previously approved a few Building, Site, and Operation Plan amendments for Tudor Oaks submitted by Greystone Developers back in 2006 but none of these amendments were ever followed through by Greystone, and   WHEREAS, A new proposal has been submitted that involves a few additions, interior and exterior renovations, and other site improvements, and   WHEREAS, The Plans submitted include building elevations, site plans, preliminary grading plans/utility plans, a preliminary landscape plan, a colored rendering/perspective, and a narrative, and   WHEREAS, The new proposal includes the following changes:   Wings A, C, E, and F will be gutted out and remodeled Wings A, C, E, and B will have additions placed at the ends of the wings that will contain additional units and indoor parking The exterior of Wing D and the Health Center will be refurbished ·         The central area will be remodeled and added on to and it will include a state-of-the-art work out facility, an indoor pool, and other amenities for the residents ·         The existing golf course will be improved ·         The main entry will be enlarged and remodeled ·         6 of the existing garage structures will be removed and the remaining garages will be refurbished ·         New stormwater management facilities will be installed on site including a stormwater management pond, site grading, and storm sewer additions   WHEREAS, Wings A, C, E, and F will be gutted out and remodeled including new windows insulated with low-e glass, replacement of some windows with patio doors, new wood and glass decks, new aluminum gutters, soffits, and fascias, new gable ends with EIFS finish, and a new shingled roof, and   WHEREAS, Wings A, C, E, and B contain the new additions that are proposed to be constructed with exterior materials matching the existing structures and the addition areas will contain material including brick to match the existing buildings, decorative stone headers and bases, wood and glass garage doors, skylights, windows insulated with low-e glass, and wood and glass decks, and   WHEREAS, There have not been details submitted at this time regarding the refurbishment to the existing garage structures that are going to remain on the property, and   WHEREAS, The property is zoned PD-6, Tudor Oaks Planned Development District, and the proposed modifications conform to the requirements of said zoning district, and   WHEREAS, The original Planned Development (PD) for this complex was adopted in April 1973 and amended in June 1974 and a Subdivider’s Agreement was recorded with the PD stipulating what was allowed, and   WHEREAS, The 2010 Comprehensive Plan depicts the property to be utilized for medium density residential purposes, and the proposal is consistent with the Plan, and   WHEREAS, The complex currently contains 261 total units and the new proposal decreases the number of units down to 238 units, and   WHEREAS, The new proposal shows that approximately 355 parking stalls consisting of approximately 223 outdoor parking spaces, 96 new attached garage stalls, and 36 existing detached garage stalls will be on site, and   WHEREAS, The number of parking stalls proposed is greater than what currently exists on the property and will supply more than enough parking for residents, employees, and guests, and   WHEREAS, There is an area shown behind the existing 16 unit detached garage that is noted to be an optional fenced RV storage/parking area and details of this area have not been provided at this time, and   WHEREAS, This proposal represents a non-substantial change to the existing PD as it is within the density restraints of the original Developer’s Agreement, and                         WHEREAS, The development will be serviced by public sewer and public water facilities, and WHEREAS, Preliminary grading/drainage plans have been submitted and are being reviewed by the City’s consultant Engineer at this time, and   WHEREAS, Stormwater Management will be facilitated by a new stormwater pond on the western portion of the development and a Stormwater Maintenance Agreement will be required for the future maintenance of the pond.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended building, site and operation plan for Tudor Oaks Retirement Community as shown on the plans submitted for the property located in the SE ¼ and SW ¼ of Section 12 (Tax Key No. 2207.999 & 2207.999.002 / S77 W12929 McShane Drive).   BE IT FURTHER RESOLVED, That all pending Engineering review comments and Landscape review comments must be completely addressed before any building permits can be issued for this project.   BE IT FURTHER RESOLVED, That a Stormwater Maintenance Agreement will be required for the future maintenance of the pond and said agreement must be approved by the City and recorded before building permits can be issued.   BE IT FURTHER RESOLVED, That all new or repainted parking stalls must be marked at 10’ x 20’ in size.   BE IT FURTHER RESOLVED, That all drive aisles must be at least 24 feet in width.   BE IT FURTHER RESOLVED, That as part of the landscape plan review, additional landscape islands may be required within some of the parking area.   BE IT FURTHER RESOLVED, That all lighting details must be submitted to the Planning Department for review and approval before any new lighting can be installed on site.   BE IT FURTHER RESOLVED, That photometric plans shall not exceed 0.5 foot candles at the property lines.   BE IT FURTHER RESOLVED, That all lighting shall consist of high-pressure sodium lights and zero degree fixtures shall be used wherever possible.   BE IT FURTHER RESOLVED, That all pole lights shall not exceed a height greater than the structures nearest to them or 15 feet, which ever is greater, and that the concrete base of any pole light shall not exceed a height of 6 inches from grade.   BE IT FURTHER RESOLVED, That all signage details must be submitted to the Planning Department for review and approval before they are installed on site.   BE IT FURTHER RESOLVED, That any new miscellaneous signage should maintain a consistent look in order to maintain the site cohesiveness.   BE IT FURTHER RESOLVED, That all mechanicals serving the site and/or structure shall be screened from public view and said screening must be approved by the Planning Department before installation.   BE IT FURTHER RESOLVED, That details regarding RV storage area should be provided to the Planning Department before this area could be installed and additional information would need to be provided such as the type of fencing, the driving surface, etc.   BE IT FURTHER RESOLVED, That information regarding phasing has not been provided at this time and if phasing is going to occur, then details regarding the phasing need to be provided before building permits can be issued.   BE IT FURTHER RESOLVED, That detailed designs and materials for the garage refurbishment must be submitted to and approved by the Planning Department before permits are issued for the work.   BE IT FURTHER RESOLOVED, The plan does not indicate the location of existing or proposed refuse containers and the location of refuse containers must be shown on the site plan and the design/materials of the enclosures must be approved by the Planning Department before building permits can be issued.   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping and/or asphalting, a bond, or cashiers check equal to twice the value of said costs must be submitted to the Planning Department.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result
