ACCEPTANCE OF PROPOSAL DATED FEBRUARY 19, 2007
FOR PROFESSIONAL SERVICES FOR THE
TESS CORNERS BOX CULVERT REPLACEMENT PROJECT
WHEREAS, The attached proposal submitted by Ayres Associates, Inc. outlines the
terms and conditions for the company to provide professional services to complete the
Tess Corners Box Culvert Replacement Project; and
WHEREAS, The Finance Committee has reviewed the documentation and has
recommended approval to the Common Council.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby accept
the proposal submitted by Ayres Associates, Inc. for the Tess Corners Box Culvert
Replacement Project.
BE IT FURTHER RESOLVED That the Mayor is authorized to sign the proposal in the
name of the City.

. AMENDMENT TO AGREEMENT
Amendment Dated February 19, 2007
The Agreement for Professional Services made as of February 17, 2006, (signed April 7,
2006), between City of Muskego, W182 S8200 Racine Avenue, Muskego, Wisconsin 53150
(OWNER) and Ayres Associates Inc, N19 W24075 Riverwood Drive, Waukesha, Wisconsin
53188 (CONSULTANT) is hereby amended as set forth below.
Ayres Associates will provide the following Scope of Services changes to the Final Design
Phase of the contract mentioned above.
DNR Coordination/Permit Compliance

· Coordinate with WDNR as to proper permit for box culvert construction.
· Edit final plan set (submitted to the City on December 5, 2006) as per WDNR comments
from email dated December 7, 2006.
· Redesign existing culvert to include poured in-place concrete wingwall with splash
guard.
· Apply for a Notification of Demolition and/or Renovation and Application for Permit
Exemption (From 4500-113 Rev 06-05).
· Write narrative descriptions for erosion control and sedimentation plan as per Trans 207.
· Submit an Erosion Control Plan and Sedimentation Plan in accordance with Trans
207.09 and 201.10.
Upon the approval of the DNR of the plans set including the items described above, Ayres
Associates will provide the following services:
· Redistribute plans to utility companies.
· Provide final QAlQC of the plans.
· Make any final revisions as requested by the WDNR or City of Muskego, issue
construction plan set.
· Complete an Opinion of Probable Costs for construction after final revisions.
Ayres Associates will add the following services to the Bidding or Negotiating Phase of the
Project.
Bidding Phase
· Send construction plan set to plan rooms.
· Assist City with Advertisement for Bids including advertisement on Ayres Associates
website.
· Distribute bidding documents from Ayres Associates office.
. · Assist City with execution of Contract Documents.

Following the Bidding Phase, Ayres Associates will add the following services:
Construction Services
· Attend the pre-construction meeting.
· Provide construction observation for box culvert construction (assume 4 weeks of
construction with 8-hour work days).
· Collect and distribute final punch list of outstanding construction items.
· Process pay requests.
· Attend final walk through.
· Complete final project closeout and administration.
Compensation and Payments
The total compensation for services listed above is estimated to be:

These rates are valid until December 31, 2007.
