PCR2008052 ./PCR2008052_files/filelist.xml RESOLUTION #PC 052-2008 Print BestFit RESOLUTION #P.C. 052-2008 APPROVAL OF A BUILDING SITE AND OPERATION PLAN AMENDMENT FOR KWIK TRIP LOCATED IN THE SE ¼ OF SECTION 8 AND THE NE ¼ OF SECTION 17 (S79 W18884 JANESVILLE ROAD / TAX KEY NO. 2192.975)   WHEREAS, On May 15, 2008 a submittal was received for Kwik Trip located at S79 W18884 Janesville Road (Tax Key No. 2192.975), and   WHEREAS, The proposal is to add a 1,629 square foot addition onto the existing convenience store/gas station, and   WHEREAS, The addition will be to the northwest side and to the rear (southwest) of the existing building, and   WHEREAS, The addition will house space for an updated kitchen, additional floor sales area, and a walk-in beer cooler, and   WHEREAS, The proposal follows the business uses found in the 2010 Plan and follows the Planned Development District zoning existing on this property, and   WHEREAS, The addition mimics the architecture and colors found on the existing structure and the architecture meets the requirements of the General Design Guide, and   WHEREAS, The condensers and air handlers will be moved to the new rooftop and they will be screened from view with a screen wall and louvers, and   WHEREAS, There is an existing dumpster enclosure on site, and   WHEREAS, No additional impervious surfaces are being added to the site, and   WHEREAS, New landscaping is being added around the existing monument sign and along the rear of the building and the landscape plan is currently in review and any comments must be addressed before building permits can be issued, and   WHEREAS, No new/additional signage or lighting are proposed at this time, and   WHEREAS, Eighteen (18) parking stalls are required for this site and there are fourteen (14) stalls provided by the building along with sixteen (16) additional parking locations by the gas pumps, totaling thirty (30) parking spots, and   WHEREAS, The site is serviced by public water and sewer, and WHEREAS, The site currently contains some outdoor storage along the front of the building, which is not allowed under their current BSO, and   WHEREAS, There is an existing changeable message sign on the property that is not following current code requirements relating to its motion and content.   THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and Operation Plan amendment submitted for Kwik Trip for an addition located at S79 W18884 Janesville Road (Tax Key No. 2192.975).   BE IT FURTHER RESOLVED, That any new/additional lighting or signage (temporary or permanent) will require separate approvals from the Planning Department and/or the Plan Commission.   BE IT FURTHER RESOLVED, That before building permits can be issued for the construction of the new addition all outside storage must be placed within the building or within the rear enclosure.  No outdoor storage/display is allowed on this property.  This includes, but is not limited to wood, propane tanks, salt, washer fluid, ice, etc.   BE IT FURTHER RESOLVED, That the changeable message sign on the property must comply immediately with the code requirements listed below relating to movement and content:   ·         Time-and-temperature devices may display the time, the temperature, activities occurring on the premises, and public events. Signs may be illuminated but nonflashing. Signs shall not be revolving, scrolling, or animated; however, time-and-temperature devices may be cyclical. Approved LED devices may advertise three (3) messages per day.  The signs may change messages or time/temperature every five (5) seconds.   The LED portion of the sign is limited to two (2) lines of text.   BE IT FURTHER RESOLVED, All dumpsters and mechanicals devices must be completely screened from surrounding view.   BE IT FURTHER RESOLVED, That any newly marked parking stalls must be 10’ x 20’ in size.   BE IT FURTHER RESOLVED, That any bollards must be painted to match the colors of the building.   BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.   Plan Commission City of Muskego   Adopted:  June 3, 2008 Denied: Deferred:     Introduced: June 3, 2008   ATTEST:  Kellie Renk, Recording Secretary
