RESOLUTION #238.2006
AUTHORIZING THE ISSUANCE OF A SUMMONS AS TO
COMPLAINT REGARDING THE
FERMENTED MALT BEVERAGE LICENSE OF
JOHNNY'S PETROLEUM PRODUCTS, INC.
WHEREAS, the City of Muskego received a Complaint against Johnny's Petroleum
Products, Inc. on December 6, 2006; and
WHEREAS, the Finance Committee has recommended the issuance of a summons
pursuant to Wisconsin Statutes to command the appearance of the licensee at a
hearing to be held before the Common Council to determine if the Class "A" Retailers'
License for the Sale of Fermented Malt Beverages should be revoked or suspended.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby authorize
the Clerk at an appropriate time before hearing to issue a summons as to complaint
received regarding the Fermented Malt Beverage License of Johnny's Petroleum
Products, Inc.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Finance Committee, does hereby
authorize the Mayor to set a hearing date.

Upon the filing of the Complaint, a copy of which is attached hereto, the Common
Council of the City of Muskego authorized the issuance of this Summons and you are
hereby commanded to appear before the Common Council of the City of Muskego at a
time and date fixed by the Mayor pursuant to Resolution #0i.35l -2006 attached hereto
at the Muskego City Hall, W182 S8200 Racine Avenue, Muskego, Wisconsin and show
cause why your license should not be revoked and/or suspended based upon the
Complaint attached hereto, said time and date being fixed as the IV day of

If you do not appear as required by this Summons, the allegations of the complaint shall
be taken as true, and if the Common Council of the City of Muskego finds the
allegations sufficient, the license shall be revoked.
. If you appear as required by the Summons and deny the Complaint, both the
complainant and you, the license holder, may produce witnesses and cross-examine
witnesses under oath and be represented by counsel.
The hearing will be transcribed in writing and you have a right to a written transcript of
the hearing at your expense.
TO: Muskego Police Department: You are hereby directed to serve this Summons and
attached Complaint upon Johnny's Petroleum Products, Inc. The Summons shall
command the licensee complained of to appear before the municipal governing body on
a day and place named in the Summons, not less than 3 days and not more than 10
days from the date of issuance. The Summons and a copy of the Complaint shall be
served on the licensee at least 3 days before the time at which the licensee is
commanded to appear. Service shall be in the manner provided under Chapter 801 for
service in civil actions in circuit court.

COMPLAINT TO THE CITY OF MUSKEGO,
WAUKESHA COUNTY, WISCONSIN,
AGAINST JOHNNY'S PETROLEUM OF MUSKEGO,
AND JACK P. STRASSER, REGISTERED AGENT
The complainant, Lieutenant John Z. La Tour, a police officer for the City of Muskego
Police Department, hereinafter referred to as complainant, for a complaint against
Johnny's Petroleum Products Inc., D/B/A Johnny's, located at S76 W17871 Janesville
Road, Muskego, Wisconsin 53150, and Jack P. Strasser as its registered agent, hereinafter
referred to as licensee, pursuant to Wisconsin Statutes 125.07(1)(a)(2), and Muskego
Ordinance 12.01, having first been dul y sworn on oath alleges on information and belief
as follows:
1. Complainant is the Operations Division Commander for the City of Muskego Police
Department and a resident of the City of Muskego. Johnny's Petroleum products, Inc. of
Muskego is a Wisconsin Corporation which owns and operates a service station with a
convenience store located at S76 W17871 Janesville Road in the City of Muskego,
Waukesha County, Wisconsin, and its vice-president and agent is Jack P. Strasser, and
said person holds alcohol beverage licenses as set forth attached Exhibit No. I, which is
incorporated herein in reference.
2. On March 9, 2006, a twenty year old person entered the convepience store at
Johnny's Petroleum Products, Inc., D/B/A Johnny's at S76 Wl7871 Janesville Road, in
the City of Muskego, Waukesha County, Wisconsin, and ordered and was sold a twelve
pack of beer, to wit: an alcohol beverage within the meaning of Wisconsin Statutes,
Section 125.07(1)(a)(2), by one Lynn N. Scaffidi, the cashier working on the premises.
3. On August 29,2006, a twenty year old person entered the convenience store at
Johnny's Petroleum Products, Inc., D/B/A Johnny's, at S76 W17871 Janesville Road, in
the City of Muskego, Waukesha County, Wisconsin, and or~ered and was sold a twelve
pack of beer, to wit: an alcohol beverage within the meaning of Wisconsin Statutes,
Section 125.07(1 )(a)(2), by one Trisha- C. Taloff, the cashier working on the premises.
4. Each ofthe above stated incidents violates Wisconsin Statutes, Section 125.07, and
Muskego Ordinance Number 12.01.
5. On each occasion the cashier working on the premises was convicted of selling
alcohol beverages, to wit: fermented malt beverages, to underage persons in violation of
the aforementioned statutes and ordinances.
6. On each occasion Jack P. Strasser, vice-president and registered agent for Johnny's
Petroleum Products, Inc., D/B/A Johnny's, was on the premises.
7. Complainant believes the information contained in this complaint is reliable because
as to each violation complainant was, as the Lieutenant of Police, the command officer
directing the police investigation, knows the police officers who observed the violations to

be truthful and reliable, and each municipal citation issued in conjunction with said
violations was based upon the personal observation of the officers who issued the charge.
Further, complainant has reviewed the police reports and other records of the City of
Muskego, believes them to be reliable, and has found them to consistently be reliable in
the past.
Complainant requests that a Summons issue, that a Hearing be scheduled and held before
the Common Council of the City of Muskego, and that the alcohol beverage license held
by Jack P. Strasser, D/B/A Johnny's, for the premises located at S76 W17871 Janesville
Road, in the City of Muskego, Waukesha County, Wisconsin, be suspended or revoked,
all pursuant to Wisconsin Statutes, Section 125.12, and the relevant ordinances ofthe City
of Muskego.
