COMMON COUNCIL - CITY OF MUSKEGO
RESOLUTION #220-2006
RESOLUTION TO RETAIN SPECIAL COUNSEL FOR REPRESENTATION
AT LIQUOR LICENSE SUSPENSION AND/OR REVOCATION HEARING
WHEREAS, The Police Department has submitted information to the Finance
Committee regarding several violations at Johnny's Petroleum Products, Inc.; and
WHEREAS, The Acting Police Chief is in the process of submitting a Complaint to the
Clerk-Treasurer requesting a hearing be held before the Common Council to consider
suspension and or revocation of the license held by Johnny's Petroleum Products, Inc.;
and
WHEREAS, As the Complainant, the Acting Police Chief cannot be represented by the
City Attorney as said attorney will be representing the Common Council; and
WHEREAS, Since the Acting Police Chief would be acting within the scope of his
employment in testifying at the hearing, the Finance Committee has recommended that
special counsel be hired to represent the Acting Police Chief.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby authorize
retaining special counsel to represent the Acting Police Chief regarding the proposed
suspension and/or revocation hearing to be held regarding the Class "A" Retailers'
License for the Sale of Fermented Malt Beverages held by Johnny's Petroleum
Products, Inc.
