RECOMMENDATION TO COMMON COUNCIL FOR A 2010 COMPREHENSIVE PLAN AMENDMENT FROM RURAL DENSITY RESIDENTIAL TO MEDIUM DENSITY RESIDENTIAL LOCATED IN THE NW ¼ OF SECTION 8 (TAX KEY NO.
2190.994.027 / HILLENDALE DRIVE).
WHEREAS, On February 26, 2008 a petition for a 2010 Plan Map Amendment was submitted by Richard Knudsen to change the 2010 Map designation from Rural Density Residential (< .49 units
an acre) to Medium Density Residential (1.5 – 3.99 units an acre) for a possible future land division for a property located on Hillendale Drive (Tax Key No. 2190.994.027), and
WHEREAS, A Public Hearing for the amendment has been scheduled before the Common Council on April 22, 2008, and
WHEREAS, The property is currently zoned RS-2 Suburban Residence District which allows parcels of a minimum 20,000 square feet and 110 feet in width when sewer is available, and
WHEREAS, The parcel is within the extents of the Milwaukee Metropolitan Sewerage District and sewer is available along Hillendale Drive to service the property, and
WHEREAS, The developer has requested the amendment due to the following:
· To be compatible with the present zoning of RS-2 Suburban Residence District (which allows minimum lot sizes of 20,000 square feet and 110 feet in width).
· To be compatible with the surrounding area zoning of RS-2 Suburban Residence District.
· To be in conformity with the surrounding land uses in which sewers are planned.
· As the property is in the extents of the sewer district
· Since the property was rezoned as part of the Citywide rezoning in 2007 to RS-2 to have lot sizes that are compatible with the lots along Hillendale Road, which are sewered
and already meet the RS-2 zoning district, and
WHEREAS, A proposed concept land division is included with the proposal showing 6 lots of .61 acres to 1.41 acres, all of which are well above the RS-2 minimum lot size requirement
of .45 acres (20,000 sq. ft.), and
WHEREAS, The proposed concept map would require changes at a formal proposal in front of Planning Commission and Common Council in regards to stormwater management, and
WHEREAS, The proposed concept actually meets the Low Density Residential Comprehensive Plan requirement (.5 – 1.49 units an acre) with 6 lots spread over 5.28 acres (1.14 units an
acre).
WHEREAS, Wetlands have been delineated and concurred by the WDNR and the DNR during a previous land division.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend approval to the Common Council for a 2010 Comprehensive Plan amendment for the property located in the NW ¼
of Section 8 on Hillendale Drive (Tax Key No. 2190.994.027) per the following:
BE IT FURTHER RESOLVED, That the amendment to the Comprehensive Plan map should be to Low Density Residential and not Medium Density Residential, as a future development will fit in
this category in a more efficient way.
BE IT FURTHER RESOLVED, That a land division will have to incorporate stormwater management, appropriate wetland setbacks, and should first receive approval and recommendations from
the City’s Conservation Commission.
