FOR GLEt\NING SERVICES WHEREAS, On June 13, 2006, the Common Council adopted Resolution #131-2006, which authorized the Mayor to execute the termination clause in the 2006 contract for cleaning services with Dust Free Cleaninç~ SE3lvice, Inc.; and WHEREAS, The Finance Committee has revÍi3wed the quotes submitted by Jani-King, Inc. and has recommended approval of the attached Agreement. The Undersigned City of Muskego ("OWNER") hereby accepts the proposal of Jani-King Inc (CONTRACTOR), and the parties agree that Jani-King lnc will supply Janitorial Services for OWNER'S premises located at: locations listed in Exhibit "A" Upon the following terms: .:. 1. Jani-King service (:harge will be $7,077 p(~r month, plus a monthly charge of$519.80 for the seasonal Parks Facilities to include all City of Muskego buildings and Park facilities. (a) The term of this Contract shall be from the datl~ of execution by the OWNER. This term shall expire on the 31 st day of December 2006. This (:ontract shall not automatically extend for additional one (1) year periods, unless at least thirty (30) days prior to expiration of the date services are scheduled to end, OWNER gives the; CONTRACTOR written notice of its intent to renew. (b )TerminationlNotice: If a party to this acgæement fails to perform according to its obligations (the non-performing party), the party claiming non-performance shall send the non- performing party written notice by certified mail, specifying the manner of non-performance. This notice will provide that the non-performing party will ht'.ve fifteen (15) days from receipt ofthe notice to cure or correct the items of non-performance. If thest: items have not been corrected or cured within this fifteen (15) day period, the claiming party may issm: a thirty (30) day written notice of termination and/or pursue other availablt: remedies for default. The monthly service charge will remain in effect for the entire term of the agreement unless there are changes in the original specifications for the premises.
