APPROVAL OF A BUILDING SITE AND OPERATION PLAN AMENDMENT FOR A WIRELESS COMMUNICATIONS FACILITY LOCATED ON THE LAIDLAW TRANSIT PROPERTY IN THE NE ¼ OF SECTION 2 (TAX KEY NO. 2165.998.002)
WHEREAS, On February 2, 2008 a submittal was received from Cricket Communications for the installation of various wireless facilities to be located on the Laidlaw Transit property
on Tess Corners Drive (Tax Key No. 2165.998.002), and
WHEREAS, The proposal is to install three antennas on the existing monopole tower and to expand the fence area to install new equipment cabinets for the operation of a wireless communications
facility to provide digital wireless telephone service to the public, and
WHEREAS, No employees would be located at the site, and
WHEREAS, Vinyl slats would be installed in the new fenced in area as exists currently on the site, and
WHEREAS, A letter is provided in the supplement from the owners of the property allowing the proposed amendments, and
WHEREAS, A landscape plan and grading plan are not part of the submittal and some landscaping may be required, and
WHEREAS, A structural analysis is provided showing sufficient structural integrity of the tower.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and Operation Plan submitted by Cricket Communications for the installation of various wireless facilities
to be located on the Laidlaw Transit property along Tess Corners Drive (Tax Key No. 2165.998.002).
BE IT FURTHER RESOLVED, That landscaping extending the arborvitaes along the new western fence line must be shown when building permits are applied for to comply with the rest of the
site.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan as they relate to landscape areas and drainage shall
be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
