PCR2008018a ./PCR2008018a_files/filelist.xml RESOLUTION #P.C. 018-2008 Print BestFit 6 pt 8.15 pt 2 2 MicrosoftInternetExplorer4 AMENDED RESOLUTION #P.C. 018-2008 APPROVAL OF AN ANNUAL REVIEW FOR G AND G SPECIALIZED CARRIERS LOCATED IN THE NE ¼ OF SECTION 17 (TAX KEY NO. 2225.999.019 / APOLLO DRIVE)   WHEREAS, The Plan Commission approved a Building, Site, and Operation Plan for G and G Specialized Carriers at the property in the Muskego Industrial Park located on Apollo Drive (Tax Key Number 2225.999.019) on June 21, 2005, by Resolution #P.C. 067a-2005, and   WHEREAS, The property is zoned M-2, Industrial District, and said use is allowed by Plan Commission approval, and   WHEREAS, Plan Commission stipulated in Resolution #P.C. 067a-2005 that due to the added concerns of having residential uses abut this property, a yearly review will continue to be held no later than the March meeting of every calendar year, and   WHEREAS, A site inspection was completed on February 25, 2008 and found outdoor storage out of compliance with the approved BSO, and   WHEREAS, Complaints have arisen from the site over the past year, usually dealing with possible sound issues during the night and the Mayor has requested that residents call the Police Department if any nighttime operations are occurring so they can be logged and the City can adequately cite the business, and   WHEREAS, No operations have been logged by the Police Department in the past year, and   WHEREAS, G and G received a BSO amendment as per Resolution #008-2007 to allow for the construction of a new outdoor storage area complete with fencing and landscaping.   THEREFORE BE IT RESOLVED, The Plan Commission approves of the annual review for G and G Specialized Carriers, subject to compliance with all conditions of approval.   BE IT FURTHER RESOLVED, A site inspection, completed on February 25, 2008, revealed numerous large scale items being stored on the west portion of the property outside of the eastside approved enclosed outdoor storage area.  These items are allowed on the west portion of the property; however, they are all to be on parked flatbed trucks.  A letter has been sent to the landowner for compliance within 7 days of the letter.  Further non-compliance will result in citations.   BE IT FURTHER RESOLVED, That an updated submittal from Mr. Swan was received on July 3, 2008 and the following requested items are approved for the property’s existing Building, Site, and Operational Plan:   ·          Erect a 113-foot long (8-foot high) chain link fence with earthtone colored slatting along the southwest portion of the western parking lot.  The fence would be on the north side of the existing vegetation. ·          Be allowed outdoor storage in front of this newly fenced area.   BE IT FURTHER RESOLVED, That the fence should be completed before outdoor storage of items is allowed.   BE IT FURTHER RESOLVED, That the site will still have to abide by the originally approved operating hours and further citations could be issued if problems arise.   BE IT FURTHER RESOLVED, That previously approved plans are kept on file in an address file in the Building Department and all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.   BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.   Plan Department City of Muskego   Adopted:    July 15, 2008 Defeated: Deferred:    March 4, 2008, April 1, 2008, May 6, 2008, June 3, 2008 Introduced: March 4, 2008 ATTEST: Kellie McMullen, Recording Secretary
