RESOLUTION #P.C. 016-2008
APPROVAL OF AN ANNUAL REVIEW FOR THE CONDITIONAL USE FOR A SALES AND SERVICE ESTABLISHMENT FOR AUTOMOBILES FOR MIDWEST AUTOWORKS AT THE PROPERTY LOCATED IN THE SW ¼ OF SECTION 9
WHEREAS, The Plan Commission approved a Conditional Use Grant amendment for sale of automobiles at the property located at W179 S7714 / 16 Pioneer Drive on May 15, 2001, and amended
said approval on March 19, 2002 by Resolution #P.C. 043-2002, and
WHEREAS, The property is zoned B-3, General Business District, and said use is allowed by Conditional Use Grant, and the Plan Commission has required an annual review as a condition
of the approval, and
WHEREAS, Approved plans permit a maximum of twelve (12) vehicles for sale to be displayed in the front parking area, and
WHEREAS, That signage and banners displayed on vehicles for sale is prohibited, except to allow for vehicle disclosure information to be visible as required by State Law, and
WHEREAS, A new car sale business, Midwest Autoworks, has been operating since 2007, and
WHEREAS, A site visit on February 25, 2008 revealed a few issues with the original approvals for the site.
THEREFORE BE IT RESOLVED, The Plan Commission approves of the annual review for Midwest Autoworks, subject to compliance with all Conditional Use Grant conditions of approval.
BE IT FURTHER RESOLVED, That the site inspection revealed cars for sale on the site that had signage displayed on the exterior of the vehicles, which is not part of the original approvals.
A letter has been sent to the owners noting that all signage must be kept on the interior of the vehicle.
BE IT FURTHER RESOLVED, That previously approved plans are kept on file in an address file in the Building Department and all aspects of this plan shall be maintained in perpetuity
unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
