PCR2008002a ./PCR2008002a_files/filelist.xml RESOLUTION #PC 002-2008 Print BestFit 6 pt 6 pt 0 AMENDED RESOLUTION #P.C. 002-2008 APPROVAL OF A PRELIMINARY PLAT FOR EDGEWATER HEIGHTS SUBDIVISON  LOCATED IN THE NW & NE ¼ OF SECTION 21 (TAX KEY NO. 2241.999 / RACINE AVENUE)   WHEREAS, On February 5, 2008 a preliminary plat was submitted by Alesci Enterprises, Inc. for the Edgewater Heights Subdivision located in the NW and NE ¼ of Section 21, and   WHEREAS, Said plat proposes 34 lots for single-family use and four (4) outlots for wetland preservation and stormwater management, and   WHEREAS, The area of the proposed development was approved for a rezoning to RSE (Suburban Residence District) and SW (Shoreland Wetland District) by Ordinance #1255, and   WHEREAS, The SW zoned areas are highly susceptible wetlands as identified by the DNR and will not be built within, and   WHEREAS, The RSE District permits sewered residential development allowing single-family residential lots of a minimum of 40,000 square feet and 150 feet in width and the preliminary plat shows no parcels less than 43,560 square feet (1 acre) in area and 150 feet in minimum average width, and   WHEREAS, The RSE zoning allows front setbacks of 40 feet and offsets of 25 feet from the side and rear lot lines, and   WHEREAS, The 2010 Comprehensive Plan has the area for Low Density Residential and the proposal meets this requirement under the rezoning previously approved, and WHEREAS, Parcels will be serviced by City sewer and water, and WHEREAS, Stormwater management would be accommodated within the outlots depicted. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a Preliminary Plat for the Edgewater Heights Subdivision, located in the NW & NE ¼ of Section 21 and will be receptive to the submittal of a final plat, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable.   BE IT FURTHER RESOLVED, That the County Engineers, City Engineer, and/or Consultant must pay special attention during the Construction Plan review process to see if any road/intersection upgrades/improvements (most notably the intersection of Woods Rd. and Racine Ave.) are required as part of the development of this subdivision.   BE IT FURTHER RESOLVED, That any road/intersection upgrades that are required are the responsibility of the developer of this subdivision.   BE IT FURTHER RESOLVED, That all Utility, Roadway, and Construction Plans must be reviewed by the Public Utility and Public Works Committees and special concern must be looked at during the Construction Plan review relating to the looping of the water main through both parts of this development.   BE IT FURTHER RESOLVED, That curb and gutter are required for this development unless otherwise waived by the Public Works Committee.   BE IT FURTHER RESOLVED, That this subdivision plan must be reviewed by the Conservation Commission before the Preliminary Plat can be approved by the Common Council.   BE IT FURTHER RESOLVED, A Subdivider’s Agreement and Letter of Credit must be approved by the Council and all subdivision improvements made and accepted before any Final Plat approvals can be allowed.   BE IT FURTHER RESOLVED, That a digital file of this Plat shall be submitted to the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.   Plan Commission City of Muskego Adopted:     April 1, 2008 Defeated:   Deferred:     Introduced:  April 1, 2008 ATTEST: Kellie Renk, Recording Secretary
