COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #039-2005 RESOLUTION TO RETAIN SPECIAL COUNSEL (Muskego Police & Fire Commission) WHEREAS, Police Chief John Johnson filed charges against Officer Jason Ziminski on February 4, 2005; and WHEREAS, Chief Johnson is being represented by the City's labor attorneys; and WHEREAS, The City attorneys' office would normally represent the Police and Fire Commission; and WHEREAS, A review of the charges indicates that in all likelihood, if this matter proceeds to a hearing, it will require that a member of the City attorneys' office appear as a witness; and WHEREAS, Because of this potential conflict, it is necessary to hire special counsel to represent the Muskego Police and Fire Commission concerning charges filed against Officer Ziminski; and WHEREAS, The City's Finance Committee has reviewed this matter and has recommended that special counsel be retained to represent the Muskego Police and Fire Commission. NOW, THEREFORE, BE IT RESOLVED That the Mayor is authorized to retain special counsel to represent the Muskego Police and Fire Commission concerning this matter at this time.
