RESOLUTION #161-2004
RESOLUTION TO TERMINATE CONDITIONAL USE GRANT
TO PERMIT THE EXTRACTION OF SAND AND GRAVEL AND A
LANDSCAPING BUSINESS
(S71 W13219 Tess Corners Drive- Tax Key No. 2206.999)
WHEREAS, On March 17, 1987, a conditional use grant was approved by Plan
Commission to allow a sand and gravel extraction operation for the property identified
as Tax Key No. 2206.999; and
WHEREAS, On September 6, 1994, a conditional use grant amendment was approved
by Plan Commission to allow the sand and gravel operation while also allowing a
landscape business for the property identified as Tax Key No. 2206.999; and
WHEREAS, On August 25, 2004 a letter was received in the Plan Department stating
that the conditional use grant for the property located at Tax Key Number 2206.999
may be terminated; and
WHEREAS, The property is now solely used as residential based upon a letter
submitted to the Planning Department requesting termination of the conditional use
grant and upon a recent building permit issued for the property for a residential
accessory building; and

WHEREAS, The Plan Commission adopted Reso. #P.C. 097-2004 recommending
complete termination of the conditional use grant in accordance with Section 6.03 (2) E.
of the Zoning Ordinance without subsequent reclassification as a legal non-conforming
use; and
WHEREAS, A public hearing was held on October 12, 2004.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Plan Commission, does hereby completely
terminate the conditional use grant, without subsequent reclassification as a legal non-
conforming use, on the property located at S71 W13219 Tess Corners Drive (Tax Key
No. 2206.999), for the reasons stated in Resolution #P.C. 097-2004, which includes a
request by the property owner to do so.
BE IT FURTHER RESOLVED That termination of said conditional use grant shall be
effective immediately upon adoption of this Resolution.
