COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #117-2004 RESOLUTION APPROVING SUBMITTING THE ATTACHED CHARTER ORDINANCE #21 TO A REFERENDUM AT THE NOVEMBER 2, 2004 GENERAL ELECTION PURSUANT TO WISCONSIN STATUTE ~66.0101(7) AND ~9.20(4) WHEREAS, the Common Council of the City of Muskego wants to give the citizens of the City of Muskego the opportunity to determine whether or not it wishes to change Charter Ordinance #13 to change the term of the office of Mayor of the City of Muskego from three (3) years to four (4) years; and WHEREAS, the new term for the office of Mayor of the City of Muskego will become effective if approved by a majority of the electors voting in such a referendum. NOW, THEREFORE, BE IT RESOLVED that the attached proposed Charter Ordinance shall be submitted to the electors of the City of Muskego at the general election on November 2, 2004 by presenting the question appearing at the bottom of the attached Charter Ordinance with a concise statement as to the nature of the same, all pursuant to v\'isconsin Statute ~66.0101(7) and Wisconsin Statute ~9.20(4) to (6). BE IT FURTHER RESOLVED that the Clerk shall take all steps necessary and provide all necessary notices to accomplish the intent of this Resolution. DATED this 22nd day of June 2004. CHARTER ORDINANCE #21 A CHARTER ORDINANCE SETTING THE TERM OF THE OFFICE OF MAYOR THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS FOLLOWS: SECTION 1: The City of Muskego pursuant to 962.09(5)(b) and 966.0101 of the Wisconsin Statutes hereby elects not to be governed by those portions of 962.09(5)(b) of the Wisconsin Statutes relating to the term of office of the Mayor for the City of Muskego which are in conflict with this ordinance. SECTION 2: Charter Ordinance #13 is repealed to the extent it is in conflict with this charter ordinance. SECTION 3: Commencing with the candidate elected at the regular spring election for the office of Mayor in April, 2005, the regular term of office of Mayor shall be four (4) years. SECTION 4: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections or portion thereof of the ordinance which shall remain in full force and effect. Any other ordinances whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict. SECTION 5: This is a charter ordinance and shall not take effect until approved by a majority of electors voting thereon at the election to be held in November, 2004 as prescribed by 966.0101(7) and 99.20(4) to (6), Wisconsin Statutes.
