CITY OF MUSKEGO RESOLUTION #085-2004 - APPROVAL OF AGREEMENT BETWEEN THE CITY OF MUSKEGO AND DENNIS SHOOK FOR USE OF VETERANS MEMORIAL PARK WHEREAS, The Finance Committee has reviewed the attached Agreement between the City of Muskego and Dennis Shook for use of Veterans Memorial Park and has recommended approval. NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Finance Committee, does hereby approve the attached agreement between the City of Muskego and Dennis Shook, Chairman of the Muskego High School Reunion Committee for use of the City's Veteran's Memorial Park on Saturday, September 4,2004. Eric Schroeder - This is to certify that this is a true and accurate copy of Resolution #085-2004 which was adopted by the Common Council of the City of Muskego. ~ \.j']J~. k- Treasurer 4/04jmb AGREEMENT - This agreement is being made with the City of Muskego regarding the use of the City's Veterans Memorial Park, located at W 182 S8200 Racine Avenue, and Dennis Shook, Chairman of the Muskego High School Reunion Committee for the specific purpose of an all Muskego High School reunion. This includes a main tent for musical entertainment, food and beer sales, and parking. I). User agrees to waive and release any and all rights and claims and damages against the City of Muskego resulting from the use of this park. 2). User agrees to restore the park to its original condition by Monday, September 6, 2004. 3). User agrees to post a $2,000 security deposit with the City of Muskego, refundable upon the park being restored to its original condition, as determined by the City of Muskego. 4). User agrees to provide, at user's expense, a policy of public liability insurance insuring itself and the City against injury to property, person or loss of life arising out of use and occupancy of the premises with limits of at least $1,000,000 aggregate. The City of Muskego must be listed as additional insured on certificate of insurance, using the form provided by the City of Muskego. A certificate of insurance to this effect must be on file with the parks and Recreation Department of the City of Muske go one week prior to event. User must also have a beer and food sales permit. - 5). User agrees to provide for security, water, electricity, garbage receptacles, picnic tables, portable bathrooms with sinks, fencing around the perimeter, and all other licenses/permits, as determined by the City of Muskego. 6). User agrees to comply with all applicable provisions of Chapter 26 of the Municipal Code of the City of Muskego. 7). The permission granted under this agreement is for use of the park only on Saturday, September 4, 2004, from 12 noon until midnight. Dated this - day of ,2004.
