RESOLUTION #270-2003
RESOLUTION OF NECESSITY

THE COMMON COUNCIL, WAUKESHA COUNTY, WISCONSIN,
HEREBY RESOLVES AS FOLLOWS:
1. That this Resolution is a resolution of necessity in accordance with
~32.06(1) and 32.07(2), Wisconsin Statutes, relating to the within-
described public improvement project;
2. That it is hereby determined that it is necessary for the City of Muskego
to acquire fee simple title for the purchase of land for park purposes;
3. That it is also necessary, in the furtherance of the above-stated public
purpose, for the City of Muskego to acquire fee simple title to the following
described real estate: See attached map marked Exhibit "An and legal
description marked Exhibit "B."

4. That the City of Muskego will acquire, by condemnation in accordance
with Chapter 32, Wisconsin Statutes, if necessary, the above-described
interest in the above-described real estate from the record owners thereof,
and from any and all other persons or entities who may have a record
interest in said real estate.
That the herein Resolution was passed and adopted by the Common
Council of the City of Muskego this 9th day of December, 2003
by a vote of 6 ayes and 0 nays.

Being part of the Northeast 1/4 of the Northwest 1/4 of Section 16, Town 5 North, Range
20 East, City of Muskego, Waukesha County, Wisconsin, bounded and described as
follows:
Commencing at the Northwest corner of Parcel described in a deed, recorded in Volume
426 Page 309 on November 30th, 1946 in Register of Deeds Office, Waukesha County,
Wisconsin, said point being the point of beginning; thence N 89027' E, 395.80 feet;
thence S 00033' E, 381.31 feet; thence S 89027' W, 395.80 feet; thence N 00033' W,
381.31 feet, to the point of beginning. Containing 150,922 sq.ft. (3.46 acres) more or less.
Bearings are referenced to the North property line of said parcel as described in a deed,
recorded in Volume 426 Page 309 on November 30th, 1946 in Register of Deeds Office,
Waukesha County, Wisconsin
