DEFEATED COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #129-2003 RESOLUTION TO TERMINATE CONDITIONAL USE GRANT IllUMINATED OUTDOOR RECREATION FACILITY MUSKEGO MOOSE LODGE PROPERTY WHEREAS, On August 3, 1999 the Plan Commission approved Resolution #PC 88-99 entitled, "Approval of a Conditional Use for the Purpose of Operating Illuminated Outdoor Recreation Facilities for the Muskego Moose Lodge at the Property Located at S86 W21693 Janesville Road (Tax Key No. 2231.995);" WHEREAS, The structures located on the property have since been razed by the property owner and the lodge use no longer operates from the premises as approved in Reso. #PC 77-99; and WHEREAS, The illuminated outdoor recreation facility was approved by the Plan Commission as an accessory use to the Muskego Moose Lodge operations; and WHEREAS, The Plan Commission adopted Reso. #P.C. 172-2002, recommending complete termination of the conditional use grant in accordance with Section 6.03 (2) E. of the Zoning Ordinance with subsequent reclassification as a legal non-conforming use; and WHEREAS, A public hearing was held on May 27,2003. NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby completely terminate Conditional Use Grant No. 149, with subsequent reclassification as a legal non-conforming use, for the Muskego Moose Lodge property located at S86 W21693 Janesville Road (Tax Key No. 2231.995), for the reasons $tated in Resolution #P.C. 172-2002. .
