CCR20022280 COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #228-2002 AUTHORIZE EXECUTION OF THE LABOR AGREEMENT BETWEEN CITY HALULIBRARY UNIT OF LOCAL 2414 AFSCME AND THE CITY OF MUSKEGO JANUARY 1,2002 -DECEMBER 31,2003 WHEREAS, A settlement agreement between the City HaMLibrary Unit of Local 2414 AFSCME and the City of Muskego for the period January 1,2002 through December 31,2003 was approved by the Common Council on April 9,2002 through Resolution #77-2002: and WHEREAS, A revised settlement, as attached, clarifies some of the language contained in the original settlement agreement and has been agreed to by all parties; and WHEREAS, The Finance Committee has reviewed the attached settlement agreement and has recommended approval. NOW, THEREFORE, BE IT RESOLVED, That the Common Council of the City of Muskego, upon the recommendation of the Finance Committee, does hereby authorize the Mayor and Clerk-Treasurer to execute the attached settlement agreement between the City HalVLibrary Unit of Local 2414 AFSCME and the City of Muskego for the period January 1,2002 through December 31,2003. Waqes A. All classifications will receive across-the-board (ATB) increases as follows: January 1,2002 - 3% January 1,2003 - 3% B. Those employees currently redlined will not be eligible for the above ATB increase, but will receive an increase to their redlined rate as follows: January 1,2002 - 1.5% January 1,2003 - 1.5% C. The parties have agreed to the following classification changes: 1 Reclassify Building Clerk from labor grade 9 to 10. 2. Reclassify Receptionist from labor grade 7 to 8. 3. Rename Voter Registration Clerk to Election ClerWCashier and 4. Rename Utilities Refuse/Recycling Clerk to Water Utility Clerk and 5. Article XVI - Vacations Amend Section 16.01 to read follows: City HalVLibrary - 2003/2003 Vacations for full-time employees shall be accrued as set forth below; part-time employees shall receive vacation on a prorated basis. During the first year of employment - two (2) weeks of paid vacation. No employee shall accrue any vacation until after six (6) months of employment; provided, however, that once an employee shall accrue six (6) months of seniority, he/she shall earn vacation as per Section 16.09. Beginning with the fifth year of employment - accrual of three (3) weeks of paid vacation. Beginning with the sixth anniversary date of employment, accrual of one (1) additional day of vacation shall be earned per year to a maximum of four (4) weeks. Beginning with the sixteenth anniversary date of employment, accrual of one (1) additional day of vacation shall be earned per year to a maximum of five (5) weeks. On any anniversary date, this accrued vacation bank cannot exceed that year's total accrual amount. 4. Article XI -Time Off for Funerals Section 11.01, Revised to read: In the event of the death of an employee's 0 spouse, five (5) days leave of absence with pay shall be granted. In the event of the death of an employee's immediate family three (3) days leave of absence with pay shall be granted. In the event of funerals out of town (more than 250 miles one way) an additional day of absence with pay shall be granted. Section 11.02. Immediate family is described as husband, wife, children, stepchildren, adopted children, parents, step-parents, grandparents, grandchildren, brothers, step-brothers, sisters, step-sisters, and spouses of both employee and spouses brother(s) and/or sister(s) spouse. Section 11.03. New Section: In the event of the death of an aunt, uncle or first cousin of employee or employee's spouse, one day (1) day of absence with pay shall be granted. All employees shall be granted ten and one-half (10 X) paid holidays each year as follows: New Year's Day Thanksgiving Day Spring Holiday One-half (1/2) day The day after Thanksgiving J3/2912002.4/18/2003) The day before Christmas Memorial Day Christmas Day Independence Day The day before New Year's Day Labor Day One (1) Floating Holiday Section 9.04. Add: If the holidays fall on a Sunday and the following Monday is a holiday, then the preceding Friday shall be observed as a holiday. Section 9.05. For AFSCME employees in the Clerk-Treasurer Department, delete New Year's Eve Day holiday and add one optional floating holiday for the purpose of tax collection. Add: If any employee from the Finance Department or a Floater volunteers to work for the Clerk-Treasurer's Department on December 31'' of 2002 or 2003 he/she will be entitled to one (1) additional floating holiday to be taken during the following year 6. Article XV - Sick Leave A. Section 15.02. Change second paragraph under B to read "Up to five (5) days per year may be taken by an employee in the event of an injury or illness to a family member, not withstanding provisions of Family Medical Leave. Family member shall be as defined in Section 1 1.02. 9. Section 15.12. Request for sick leave for employee, spouse, children and individuals for whom you are primary caregiver, doctor and dentist appointments shall be granted up to a maximum of sixteen (16) hours per year Employees shall, where possible, schedule such appointment after consultation with their supervisors concerning mutually convenient times for the taking of such leave, and shall attempt to schedule such appointments so as to minimize the impact upon working time. Employees shall give four (4) workdays advance notice prior to requesting such leave. C. Section 15.13. The parties have agreed to the principle of the use of allowing employees to direct the dollars from the payment accumulated sick leave at the time of retirement to the cost of retiree health insurance, at the employee's option. The contract language will be drafled to reflect this right. If possible, the language will provide for the greatest tax advantage to the employee. a ARTICLE XVII - INSURANCE 3 City HaWLibrary - 2003/2003 Section 17.01. -The Employer shall provide hospital and surgical, major medical, 0 outpatient and diagnostic coverage during the term of this Agreement. The Employer may offer additional insurance programs during the term of this Agreement provided it continues existing basic health insurance coverage. Employees will contribute $10.00 per month for family coverage and $5.00 per month for single coverage. These deductions will be made on apre-tax basis pursuant to the City’s premium only cafeteria plan. Effective June I, 2002, the insurance plan will be changed to the Wisconsin Physicians Service, Preferred Advantage Plus Plan, for groups of 51 or more as negotiated. Specific levels of coverage will be provided for in the WPS plan. The insurance plan consists of a $250.00/$500.00 deductible. Medical services, requiring a deductible, which are received fiom an “In-plan provider” will be covered loo%, after the deductible of $250.00. “Out of plan” will be covered 70%, to a maximum out-of-pocket cost of $2,500. All Tier 1 generic drugs will have a $5.00 co-pay, Tier 1 lwill have a $10.00 co-pay, and Tier I I1 category (named on specific list) will result in a minimum of $25.00 drug co-pay depending on cost of drug. A drug will not be in the Tier I1 1 category unless there is an alternative in either Tier 1 or Tier 11 or both. If not medically necessary, the cost to the user who chooses to take a drug in Tier 11 I will be the net of the actual drug cost minus the $25 co-pay. There is a $50.00 co-pay for each emergency room visit. The City shall have the right to change the healthcare provider during the term of this Agreement, the replacing coverage shall be equal to or greater than the benefits in effect as of June 1,2002. In the event a successor agreement is not reached as of the effective date of the expiration of this Agreement, these benefits, as well as the City’s premium contribution, shall be subject to the dynamic status quo document. The current vision care rider shall terminate at midnight on December 3 1,2002. Thereafter, there will be no vision care rider. Section 17.02. City will participate, on behalf of all fulltime and eligible part-time employees, in the group term life insurance program offered through the Wisconsin Retirement Service (hereinafter “WRS Life Plan”). Participation in the WRS Life Plan shall be as pursuant to the rules established by the Wisconsin Retirement Service. FTE Premiums The City will pay one hundred percent (100%) of the premium cost for the standard WRS Life Plan benefits for full time employees. Full time employees may also purchase supplemental coverage under the WRS Life Plan, if eligible, at their own expense through authorized payroll deductions. PTE Premiums For eligible part time employees who exercise their option to participate in the WRS LIFE Plan, the City will pay a prorated portion of the premium cost for the standard WRS Life Plan benefit, based on the percentage of full time hours that the part time employee is regularly scheduled to work. In no event shall the City’s contribution for a part time 4 City HalVLibrary - 2003/2003 @ cost. employee's WRS Life Plan standard benefit be less than twenty percent (20%) of the premium Section 17.03. Employees covered by this Agreement shall be allowed to carry the family plan to cover hisiher spouse andor dependents. Section 17.04. The Employer shall continue to pay Hospitalization and Surgical Insurance and Group Life Insurance premiums for a period of up to six (6) months for employees who are absent from work due to sickness or accident not covered by Worker's Compensation whose sick leave has been exhausted. Section 17.05. The Employer shall provide optional dental insurance coverage and the employee shall pay the full premium cost of such insurance for both the single plan and the family plan. Section 17.06. Employees who retire may elect to retain coverage under the group health insurance plan; provided that such employee has reached the age of fifty-five (55) and has ten (10) years of continuous calendar years of service as of the date of retirement. In order to retain such coverage, such employees must pay the monthlypremiums for the group health insurance plan to the City Clerk-Treasurer. Section 17.07. A qualified retired employee who drops health or dental insurance may re-enroll at a future date, and ifnot enrolled at the time of retirement, may enroll at a future @ date, provided they meet the requirements as set forth in Section 17.06 of this Agreement. The City agrees to enroll retired employees in the health plan as the City may have for employees with the retired employee (or widow or widower) to pay the premium required for said coverage. A retired employee shall be entitled to enroll in a family plan coverage if he or she has dependents, provided he/she meets the provisions of Section 17.07 of this Agreement. Section 17.08. All full-time and regular part-time employees who have incurred a work-related full disability according to Social Security or Wisconsin Retirement regulations, shall be allowed to enroll in the health insurance plan offered by the City (family plan if applicable), with the disabled employee to pay the premium of said coverage, with no minimum length of service or age limitation required.
