RESOLUTION TO TERMINATE CONDITIONAL USE GRANT
PRESTIGE AUTO
WHEREAS, On December 17, 1991, the Plan Commission approved a Building, Site and
Operational Plan and Conditional Use Grant for Prestige Auto for the repair and painting of
automobiles, boat repair and boat parking for the property identified as Tax Key No. 2165.984,
with said approvals amended by the Plan Commission on May 5, 1992; and
WHEREAS, The Waukesha County Department of Transportation has advised the City of
Muskego of its intent to acquire and raze the Prestige Auto building as a part of the 2003-2004
reconstruction of Janesville Road, and said action requires the relocation of Prestige Auto; and
WHEREAS, The Plan Director and City Attorney have reviewed the matter and recommend that
the Conditional Use Grant be terminated and reclassified as a legal nonconforming use; and
WHEREAS, The Plan Commission adopted Reso. #P.C. 145-2002, recommending termination
of the conditional use grant in accordance with Section 6.03 (2)(E) of the Zoning Ordinance with
subsequent reclassification as a legal nonconforming use; and
WHEREAS, A public hearing was held on November 12, 2002
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego.
upon consideration of the recommendation of the Plan Commission, does hereby completely
terminate Conditional Use Grant No. 11 1, on Prestige Auto located at S66 W14543 Janesville
Road (Tax Key No. 2165.984).
BE IT FURTHER RESOLVED That complete termination of said Conditional Use Grant shall be
effective immediately upon adoption of this Resolution.
