CCR2002119COMMON COUNCIL -CITY OF MUSKEG0 RESOLUTION #119-2002 APPROVAL OF FINAL PLAT, SUBDIVIDER'S AGREEMENTS AND LETTER OF CREDIT Riverview Court Subdivision WHEREAS, A Final Plat was submitted for Riverview Court Subdivision located in the SE of Section 10 to create 20 residential parcels and three outlots; and WHEREAS, The Plan Commission has recommended approval through Resolution #P.C. 049- 2002; and WHEREAS, Subdivider's Agreements and Letter of Credit have been received for Riverview Court Subdivision and the Finance Committee has recommended approval. NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby approve the Final Plat for Riverview Court Subdivision, subject to approval of the City Engineer and all objecting and approving agencies, and receipt of all fees as provided in Section 18.14 of the Land Division Ordinance and any special assessments which may be due. BE IT FURTHER RESOLVED That the Subdivider's Agreements and Letter of Credit for Attorney and City Engineer, all of said approvals to be obtained within thirty (30) days of the Riverview Court Subdivision, as attached, are hereby approved subject to approval of the City date of approval of this Resolution or the same will be null and void. BE IT FURTHER RESOLVED That a digital '.DXF file, '.DGN file, or '.DWG file of this final plat be submitted to the City prior to City signatures being placed upon the plat (3-112 diskette) and Coordinates NGVD 1929 or others approved by the City Engineer BE IT FURTHER RESOLVED That prior to execution of the Final Plat by the City, approval by the Plan Commission of a Street Tree Plan and Landscape Plan for the Woods Road planting easement is required. PLAN CONSISTENCY PC 049-2002 r" r The 2010 Plan depicts the area for medium density residential development Comprehensive Plan: consistent with RS-2 and RS-3 zoning. The proposal is consistent with the adopted plan. The properly is zoned RS-3 Suburban Residence District, permitting parcels of 15,000 square feet and 100 feet in width. The proposal is consistent with district requirements. The remnant parcel includes numerous outbuildings. Parcel 20 has suflicient land area to allow all buildings to remain. The 2001-2005 Plan does not depict land acquisition or public improvements in the area. The proposal is consistent with the Plan. Zoning: Park and Open Space 'Ian: A recreation trail be extended from Woods Road to the WEPCO Trail. The Park and Recreation Board has reviewed the proposal and has concurred. An outlot has been illustrated between two parcels to accommodate this feature. The Plan does not identify this parcel for land management or acquisition. The proposal is consistent with the Plan. The 2010 Street System Plan depicts Woods Road to be a 100 foot Ultimate right of way. The proposal depicts a 50 dedication from centerline, and is consistent with the adopted Plan. Direct parcel access to Woods Road has been eliminated as recommended by staff. Reservations for future Street extensions have been illustrated as recommended by stall. Street names have been revised per requirements of Preliminary Plat approval. The Director of Building 8 Engineering believes that the "reserved right-of-way should be required to be dedicated. The Resolution is drafted to accommodate this as a 'technical correction' if it Droves to be required. Conservation Plan: Street System Plan: Utility Service Areas: The parcel is within the sanitary sewer service area and water service area. Both public utilities are proposed to serve the development. RESOLUTION #P.C. 049-2002 RECOMMENDATION OF APPROVAL OF A FINAL PLAT FOR THE RIVERVIEW COURT SUBDIVISION FOR THE SWIATALA PROPERTY, LOCATED IN THE SE1/4 OF SECTION 10 (TAXKEY NO. 2200.985 / WOODS ROAD) WHEREAS, A Final Plat was submitted by John Elliot and Thomas Beaudry for Riverview Court Subdivision for the Switala property located in the SE 114 of Section 10, and WHEREAS, Said plat proposes 20 lots, ranging from 15,000 square feet to 3.91 acres in size, and WHEREAS, Said property is zoned RS-3 Suburban Residence District, requiring a minimum lot size of 15,000 square feet and an average minimum width of 100 feet, and said lots appear to meet said minimum zoning requirements, and WHEREAS, Said Final Plat substantially conforms to that of the Plan Commission's previously approved Preliminary Plat, under Resolution #P.C. 171- 2001, on November 20, 2001, and 0 WHEREAS, The 2010 Comprehensive Plan depicts this area for medium density residential development, and the proposal is in conformance with the Plan, and WHEREAS, Said parcels will be serviced by City sewer and water, and THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a 20 parcel and three outlot Final Plat for Riverview Court Subdivision for the Switala property located in the SE 114 of Section 10, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable.
