CCR2002015COMMON COUNCIL -CITY OF MUSKEG0 RESOLUTION #I52002 APPROVAL OF PRELIMINARY PLAT Big Muskego Estates WHEREAS, A preliminary plat for Big Muskego Estates in the SE % and SW % of Section 13 was submitted on November 28,2001, and WHEREAS, Said plat proposes the development of 54 residential lots and 49 acres of common space: and WHEREAS, The Plan Commission has recommended approval of the preliminary plat subject to the conditions of Resolution #P.C. 187-2001 as adopted. NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby approve the preliminary plat of the Big Muskego Estates in the SE % and SW % of Section 13 subject to the conditions outlined in Resolution #P.C.187-2001 being met at the time of the final plat. BE IT FURTHER RESOLVED That this approval is subject to receipt of the submittal fees and favorable reports from all approving and objecting agencies, and passage and publication of Ordinance #1090, and approval and execution of the Pre-development Agreement for Big Muskego Estates. William Le Doux This is to certify that this is a true and accurate copy of Resolution #15-2002 which was adopted by the Common Council of the City of Muskego. 0 1/2002jmb RESOLUTION #P.C. 187-2001 APPROVAL OF PRELIMINARY PLAT FOR BIG MUSKEG0 ESTATES BY TOWNE REALTY, LOCATED IN THE SE '/4 AND SW X OF SECTION 13 (TAX KEY NO. 221 1.999) WHEREAS, On November 28, 2001 a preliminary plat was submitted by Towne Realty for the Benke-Schweitzer property located in the SE % and SW '/4 Of Section 13, and WHEREAS, The plat consists of 92 acres, proposes 54 parcels, and provides 49 acres of common open space, and WHEREAS, Said property is proposed to be rezoned to RS-2/0PD Suburban Residence District and Planned Development Overlay District, with SW Shoreland Wetland District, and a Public Hearing is scheduled for January 8, 2002, and WHEREAS, The 2010 Comprehensive Plan depicts this area for residential development at a density not to exceed one dwelling unit per acre, and the yield plan and sketch preliminary plat illustrate a density of 0.55 dwelling units per e acre, and WHEREAS, Said parcels will be serviced by City sewer, and WHEREAS, Said parcels may be served by private community water system, and WHEREAS, The 2010 Street System Plan depicts Durham Drive to have a 100 foot wide ultimate width, and the proposal is consistent with the Plan, and WHEREAS, Wetlands, floodplain, and shoreland wetlands exist on the property and are depicted to be preserved as common open space, and WHEREAS, The Conservation Plan depicts the wetlands, floodplain, and shoreland wetlands as a high management priority, and WHEREAS, The lands proposed to remain in common open space are within the project boundary of the Big Muskego Lake Wildlife Area, and their preservation will further the goals of the Wisconsin Department of Natural Resources with minimal public investment, and 0 WHEREAS, The plat is required to provide on-site stormwater management as required by Chapter 34, and the sketch preliminary plat accommodates this in conjunction with a wetland restoration effort promoted by the Wisconsin Department of Natural Resources. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a 92 acre, 54 parcel, preliminary plat of Big Muskego Estates Subdivision for the Benke-Schweitzer property as proposed by Towne Realty, and located in the SE ?A and SW 'h of Section 13. BE IT FURTHER RESOLVED, That the Plan Commission recommends the rezoning to RS-2 I OPD Suburban Residence District with Planned Development Overlay District, and SW Shoreland Wetland District, with residential parcels being a minimum parcel size of 20,000 square feet and a minimum average parcel width of 110 feet. Common Council also approved the concept by Resolution #202-2001 on October 23, 2001 The property is approximately 88 acres in size, and includes substantial marsh and lake frontage. A total of 54 permanent open space. parcels are proposed to be located east of Durham Drive. The west side of Durham Drive is proposed to remain in The Mayor's Office and Planning Staff have worked very closely with the petitioner and representatives of the DNR. The submittal represents what all of the parties agree is the best approach to development. 0 PLAN CONSISTENCY PC 187-2001 ~____ The 2010 Plan depicts the entire property for residential development at densities not to exceed one dwelling per acre. The planned development district has a density of approximately 0.55 units per acre, and conforms to the Comp Plan's density objectives. The property is currently split-zoned, being RSE sewered residential oning: wetland. The development will require rezoning the entire property to RS- development, R-2 unsewered residential development. and SW shoreland UOPD (minimum 20,000 square foot parcels). Wetlands and floodplain are located within the conservancy area. The existing residence and agricultural buildings located to the west of Durham Drive are proposed to remain, and will be divided by Certified Survey Map. A 30 foot wide landscape easement is depicted along Durham Drive. Staff recommends that the westward views should be preserved. No berming should be required.
