AMENDED RESOLUTION OF NECESSITY
(Public Lake Access)
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WAUKESHA COUNTY,
WISCONSIN, HEREBY RESOLVES AS FOLLOWS:

That this Resolution is an amendment to a Resolution of Necessity which is Resolution
#237-2001 passed and approved on November 27,2001
That this Resolution is an amended resolution of necessity, in accordance with §32.06(1)
and §32.07(2), Wis. Statutes relating to the within-described public improvement project;
That it is hereby determined that it is necessary for the City of Muskego to acquire an
interest in real estate by long-term lease or otherwise for public lake access including, but
not limited to, boat launch and parking;
In furtherance of the above stated public purpose, the City of Muskego must acquire an
interest in the real estate by long-term lease or otherwise to the real estate more
specifically described on attached Exhibit “A” and attached Exhibit “B” consisting of a
legal description and map;
That the City of Muskego will acquire, by condemnation in accordance with Chapter 32,
Wis. Statutes, if necessary, the above-described interest in the above described real-estate
from the record owners thereof and from any and all persons or entities who may have a
record interest in said real estate.
That the herein Resolution was passed and adopted by the Common Council of the City of
Muskego this 1 Ith day of December, 2001 by a vote of 7 ayes and 1 nays.

Commencing at the Southwest comer of Parcel 2, Certified Survey Map No.
8 153, said point also being the point of beginning of lands described herein; thence North

71”25’32” West 350.77 feet to a point on a meander line on Big Muskego Lake; thence
