CCR2001199COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #199-2001 SECOND AMENDMENT TO FINAL RESOLUTION AUTHORIZING INSTALLATION OF IMPROVEMENTS AND LEVYING OF SPECIAL ASSESSMENTS (Movie-PlexlS67 W19491 Tans Drive) AGAINST BENEFITED PROPERTY - RESOLUTION #137-2000 WHEREAS, the owners of the property described as follows have requested that the City provide improvements to said property including detention pond, drainage and landscaping improvements: Tax Key No. MSKC 2180.994.001 Address: S67 W19491 Tans Drive Muskego, Wisconsin and WHEREAS, said property owners have executed a Waiver of Special Assessment Notices and Hearings Under §66.60(18), Wisconsin Statutes; and WHEREAS, the property owners have agreed in said waiver that the benefit to said property is equal or greater than the cost thereof; and WHEREAS, the City has made said assessment pursuant to Resolution #137-2000 and Resolution #216-2000; and WHEREAS, all costs of said project have now been determined and are less than originally anticipated; and WHEREAS, The City has agreed to reduce the final assessment resolution to the actual cost of the project. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1 That the assessments due pursuant to Resolution #137-2000 and Resolution #216-2000 are amended to be $7,079, and may be paid in cash in full on or before November 1, 2001, or in fifteen (1 5) annual installments of principal together with twelve (12) months interest per installment to the Clerk-Treasurer, installment payments to bear interest at the rate of 8% per annum on the unpaid balance commencing on November 1, 2001 and said first installment being due on the date when real estate taxes are due and annually thereafter All -1 - assessments or installments which are not paid by the date specified shall be extended upon the tax roll as a delinquent tax against the property and all proceedings in relation to the collection, return and sale of property for delinquent real estate taxes shall apply to such special assessment, except as otherwise provided by statute. by this Resolution remain in full force and effect. assessment district and mail a copy to every property owner whose name appears on the assessment roll whose post office address is known or can with reasonable diligence be ascertained. 2.
