The existing driveway access serving the residence and outbuildings should be removed, and all access provided by the internal subdivision street. A vehicle access restriction to Field Drive should be placed on the Final Plat. Street System Plan: Vision corners are provided as required by Ordinance. The Public Works Committee is scheduled to review the plat at their October meeting, to determine if a rural street cross section will be permitted. The property is proposed to be served by private sanitary systems and private Utility Service Areas: STAFF DISCUSSION PC 156-2001 The Plan Commission previously approved a sketch land division of the properly, using the underlying RCE district zoning. A total of 13 parcels, each being 2.75 acres in size were depicted. The approved sketch constitutes the "yield plan", which is required in order to determine the base density of the conservation subdivision. Once this base density has been approved, the development is eligible for density bonuses in exchange for achieving certain conservation goals. A maximum of a 15% bonus, or three additional parcels, is possible. The proposal depicts the maximum bonus, for a total of 16 residential lots. The proposal achieves 53% open space, even with the maximum bonus. Several of the criteria for receipt of the bonus can not be evaluated until engineering plans are reviewed. The Resolution is drafted with a conditional approval of the density bonus. A Detailed Site Analysis has been provided which illustrates the environmentally significant features of the property. is permitted by the conservation subdivision ordinance. However, the disturbance to the parcels is required to be Parcels 6 and 7 encroach onto a steep slope, and parcels 8, 9, and 10 encroach into the upland woodlands. A Management Plan will be drafted in conjunction with the construction plans. RESOLUTION #P.C. 156-2001 RECOMMENDATION OF APPROVAL OF A PRELIMINARY PLAT FOR THE MARTIN ESTATES SUBDIVISION BY REALCAP LLC LOCATED IN THE SW114 OF SECTION 7 (TAX KEY NO 2187.999) 0 WHEREAS, On September 21, 2001 a preliminary plat was submitted by RealCap LLC for Martin Estates located in the SW '/4 of Section 7, and WHEREAS, Said plat consist of approximately 50.3 acres, and proposes 16 residential parcels, ranging from approximately 44,000 square feet to approximately 60,000 square feet in size, and one outlot, and WHEREAS, Said property is zoned RCE Residential Country Estate District, and is proposed to be rezoned to include the COPD Conservation Planned Development Overlay District, and WHEREAS, The Plan Commission has previously approved a 13 parcel sketch land division, which satisfies the requirement for a Yield Plan, and WHEREAS, The preliminary plat proposes three residential parcels in addition to the base density permitted by the RCE District, and said parcels may be Demitted Drovided that three of the eiaht criteria of Section 18.81(2) of the Land a Division Okdinance are found to be m;, and WHEREAS, The 2010 Comprehensive Plan depicts this area for rural density residential development, and WHEREAS, Said parcels will be serviced by private sanitary sewer and water facilities, and WHEREAS, The 2010 Street System Plan depicts Field Drive to have an 80 foot wide ultimate right-of way, and the appropriate dedications are illustrated, and WHEREAS, Public right-of-way reservations have been extended to the east plat line, and WHEREAS, Wetlands, woodlands, and steep slopes are present on the subject parcel, and a Detailed Site Analysis has been provided, and WHEREAS, The DRAFT Conservation Plan depicts the parcel as having medium priority Land Management objectives, and a Management Plan for Outlot 1 will be required concurrent with the Final Plat, and WHEREAS, The 2001-2005 Park and Open Space Plan does not identify any land acquisitions in the area, and THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a 50.3 acre, 16 parcel, 1 outlot, preliminary plat for Martin Estates Subdivision by RealCap LLC located in the SW ?A of Section 7 and will be receptive to the submittal of a final plat, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if applicable. a BE IT FURTHER RESOLVED, That the inclusion of three residential parcels as illustrated on the September 21, 2001 submittal is conditioned upon final determination by the Common Council that at least three of the density bonus criteria of Section 18:81(2) of the Land Division Ordinance have been met.
