CCR2001192COMMON COUNCIL - CITY OF NEW BERLIN RESOLUTION NO. 01-29 COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #192-2001 RESOLUTION ADOPTING A JOINT POWERS AGREEMENT FOR THE 91 1 EMERGENCY SYSTEM WHEREAS, the City of New Berlin and City of Muskego have implemented an Emergency 91 1 System for the purposes of providing emergency services to residents and visitors of their municipalities, including fire fighting, law enforcement, ambulance, medical and other emergency services; and WHEREAS, Sec. 146.70(9), Wis. Stats., "Joint Powers Agreement," requires that in implementing a 91 1 System as has been done in the cities of New Berlin and Muskego, municipalities shall annually enter into a Joint Powers Agreement, which Agreement shall be applicable on a daily basis and which shall provide that if an emergency services vehicle is dispatched in response to a request through the City of New Berlin or Muskego 91 1 System, such vehicle shall render its services to the persons needing the services, regardless of whether the vehicle is operating outside the vehicle's normal jurisdictional boundaries. NOW, THEREFORE, BE IT RESOLVED That in consideration of the mutual promises, agreements, and conditions contained herein, it is hereby jointly agreed between the 0 cities of New Berlin and Muskego, as follows: 1 That effective November 1, 2001, this Agreement shall, thereafter be applicable on a daily basis from said date through October 31, 2002, and shall thereafter automatically renew on the same terms unless either municipality notifies the other at least thirty (30) days prior to the expiration of the agreement. 2. That if an emergency services vehicle operated by either municipality, or operated by an agency with which the municipality contracts for that particular emergency service, is dispatched in response to a request through either city's Emergency 91 1 System, such vehicle (whether owned and operated by the Municipality or by the agency) shall render its services to the persons needing the services, regardless of whether the vehicle is operating outside the vehicle's normal jurisdictional (or as defined by contract) boundaries. 3. That a copy of this Agreement shall be filed with the State Department of Justice, as required by Sec. 146.70(9)(c), Wis. Stats. BE IT FURTHER RESOLVED That the Mayor and Clerk-Treasurer are authorized to accept the terms of the agreement and execute same on behalf of the City of Muskego.
