CCR2001141COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #141-2001 RESOLUTION OF NECESSITY (Conservation Purposes-Engel-Ewald) THE COMMON COUNCIL, CITY OF MUSKEGO, WAUKESHA COUNTY, WISCONSIN, HEREBY RESOLVES AS FOLLOWS: 1 That this Resolution is a resolution of necessity in accordance with 532.06(1) and 32.07(2), Wisconsin Statutes, relating to the within- described public improvement project. 2. That it is hereby determined that it is necessary for the City of Muskego to acquire fee simple title for the purchase of land for conservation purposes in order to implement the goals of the 2010 Comprehensive Plan, as adopted March 13, 2001 pursuant to the authority granted by 562.23 Wisconsin Statutes, and in order to implement the recommendations of the draft Conservation Plan, anticipated to be adopted as an element of the 2010 Comprehensive Plan in order to meet the agricultural, natural, and cultural resources objectives of 562.23 Wisconsin Statutes. 3. That it is also necessary, in the furtherance of the above-stated public purpose, for the City of Muskego to acquire fee simple title to the following described real estate: See attached legal description marked Exhibit “A and map marked Exhibit “B.” 4. That the City of Muskego will acquire, by condemnation in accordance with Chapter 32, Wisconsin Statutes, if necessary, the above-described interest in the above-described real estate from the record owners thereof, and from any and all other persons or entities who may have a record interest in said real estate. That the herein Resolution was passed and adopted by the Common Council of the City of Muskego this 24th day of Julv ,2001 by a vote of 7 ayes and 0 nays. Bounded and described as follows: The East fifty acres of the South % of the Northwest 1/4 excepting six acres as described in Volume 167, Page 210, at the Register of Deeds Office, Waukesha County, Wisconsin; The Southwest 1/4 of the Northeast 1/4 excepting that portion of lands with Tax key number 2237-994; The West % of the Northwest 1/4 of the Southeast %; The East thirty acres of the Northeast % of the Southwest % and described exceptions.
