CCR2001138COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #138-2001 APPROVAL OF CERTIFIED SURVEY MAP Bonnert, Town of Norway WHEREAS, A Certified Survey Map was submitted to finalize a three-parcel division of the Bonnert property located on Racine Avenue in the NE % of Section 5 in the Town of Norway: and WHEREAS, This property is located within the extra-territorial jurisdiction of the City of Muskego; and WHEREAS, The Plan Commission has recommended approval with the adoption of Resolution #P.C. 093-2001 NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby approve the Certified Survey Map to finalize a three-parcel division of the Bonnert property located on Racine Avenue in the NE '/4 of Section 5 in the Town of Norway subject to the conditions outlined in Resolution #P.C. 093-2001 BE IT FURTHER RESOLVED That this approval is subject to receipt of all fees required by Section 18.14 of the Land Division Ordinance and approval of the City Engineer DATED THIS 24th DAY OF Julv ,2001 SPONSORED BY: Ald. William Le Doux This is to certify that this is a true and accurate copy of Resolution #138-2001 which was adopted by the Common Council of the City of Muskego. 7/0ljrnb RESOLUTION #P.C. 093-2001 OBJECTION TO AN EXTRATERRITORIAL CERTIFIED SURVEY MAP FOR THE BONNERT PROPERTY LOCATED IN THE NE X SECTION 5, TOWN OF NORWAY 1 WHEREAS, On June 18. 2001 A Certified Survey Map for a three (3) lot land division was submitted by Russell Bonnert for the property located in the NE % of Section 5. Town of Norway. and WHEREAS, This property is located within the jurisdiction of the extraterritorial powers of the City of Muskego and approval by the Plan Commission is necessary under the City's subdivision regulations, and WHEREAS, The property appears to be in the Muskego-Wind Lakes Priority Watershed, and there appears to be no adverse drainage impacts to the City of Muskego, and WHEREAS, The Certified Survey Map indicates "right-of-way varies" along Racine Avenue, and the appropriate dedications should be illustrated as required by the Racine County Department of Transportation, and WHEREAS, Parcel 1 contains a navigable waterway and the meander line and ordinary high- water mark must be illustrated, and WHEREAS, The navigable stream setback and shoreland jurisdictional limits are to be measured from the ordinary high-water mark, and WHEREAS, it is the opinion of the Attorney General that "a river, stream, or creek that crosses a on the Certified Survey Map, and parcel legally divides said parcel as a highway would," and said division is not properly illustrated WHEREAS, The Town of Norway must also approve of all land divisions within their jurisdiction.
