CCR2001135COMMON COUNCIL -CITY OF MUSKEG0 RESOLUTION #135-2001 APPROVAL OF CERTIFIED SURVEY MAP Dreamland Planned Development WHEREAS, A certified survey map was submitted on May 25, 2001 to finalize a four- parcel land division of the Dreamland Planned Development property located on Janesville and Moorland Roads in the SE '/4 of Section 2; and WHEREAS, The Plan Commission adopted Resolution #P.C. 082-2001 recommending approval. NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby approve the certified survey map to finalize a four-parcel land division of the Dreamland Planned Development property located on Janesville and Moorland Roads in the SE '/4 of Section 2 subject to the conditions outlined in Resolution #P.C. 082-2001 BE IT FURTHER RESOLVED That this approval is subject to receipt of all fees required by Section 18.14 of the Land Division Ordinance, any special assessments which may be due, and approval of the City Engineer BE IT FURTHER RESOLVED That this approval is subject to passage and publication of Ordinance #I074 and adoption of Resolution #136-2001 BE IT FURTHER RESOLVED That a digital *.DXF file, '.DGN file, or *.DWG file of this Certified Survey Map be submitted to the City prior to City signatures being placed upon the CSM (3-1/2" diskette) and all information transmitted on the diskettes shall be tied to and referenced to State Plane Coordinates NGVD 1929 or others approved by the City Engineer DATED THIS 24th DAY OF July ,2001 SPONSORED BY: Ald. William Le Doux This is to certify that this is a true and accurate copy of Resolution #I3 was adopted by the Common Council of the City of Muskego. 5-2001 which 7/2001jmb 1 RESOLUTION #P.C. 082-2001 RECOMMENDATION OF APPROVAL OF A CERTIFIED SURVEY MAP FOR A FOUR LOT LAND DIVISION OF THE DREAMLAND PLANNED DEVELOPMENT DISTRICT PROPERTY LOCATED IN THE SE ‘/4 OF 8 I SECTION 2 (PART OF TAX KEY NO. 2167-995) I WHEREAS, A Certified Survey Map was submitted on May 25, 2001 and revised on May 30, 2001, by National Survey and Engineering for a four (4) lot land division of the Dreamland Planned Development District property located in the SE of Section 2, and WHEREAS, Said Certified Survey Map is a redivision of a Certified Survey approved for the Dreamland Planned Development District, and is required in order to address the proposed amendments to the District as identified by Resolution #PC 048-2001, and WHEREAS, Said property has split-zoning, being zoned RSE Suburban Residence District, and B-YOPD General Business District with Planned Development Overlay District, and the property is subject to a rezoning petition encompassing 6.99 acres of land pursuant to Resolution #PC 084-2001, and WHEREAS, The 2010 Comprehensive Plan depicts this area for mixed use commercial and multiple family residential development consistent with the approved Dreamland Planned Development District, and an amendment to the Plan is proposed pursuant to Resolution #PC 083-2001, and WHEREAS, Said parcels are proposed to be serviced by City sewer and water, and WHEREAS, Cross access easements are proposed to serve all parcels within the Dreamland Planned Development District, and WHEREAS, Cross access easements are proposed to serve areas adjacent to Koso Drive, as well as other adjoining parcels which are depicted for commercial development in the 2010 Comprehensive Plan, and WHEREAS, Wetlands and isolated natural resource areas are present on the property and easements are proposed to assure their long term preservation, and WHEREAS, Stormwater management easements to serve the four parcels are illustrated on Parcel 3, and the owner of Parcel 3 will be solely responsible for the maintenance and care of all stormwater appurtenances located therein, and WHEREAS, Sanitary sewer and water main easements are required to be illustrated on the Certified Survey Map, and 8 8 8 WHEREAS, Existing sanitary sewer and water main easements cross the property in accordance with the Certified Survey Map recorded for the approved Dreamland Planned Development District, and said easements must be vacated in conjunction with this Survey, and WHEREAS, Access to Janesville Road and Moorland Road is subject to the jurisdiction of the Waukesha County Department Of Transportation, and said approvals have not been received, and WHEREAS, Existing structures, private wells, and on-site sanitary systems are known to exist on the site, and must be depicted on the Certified Survey Map. WHEREAS, All existing structures are proposed to be removed, and all existing private wells and on-site sanitary systems are proposed to be abandoned, and WHEREAS, Visions corner easements are required to be depicted on the Certified Survey Map. THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a Certified Survey Map for a four (4) lot land division of the Dreamland Planned Development property located in the SW 'h of Section 2 subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That this approval is subject to Waukesha County Department of Transportation approval of access locations, vision corner easements, and right-of-way widths, and the execution by the property owner of any permits and agreements required to receive said approvals. BE IT FURTHER RESOLVED, That prior to receipt of City signatures on the Certified Survey Map, all sanitary sewer, water main, stormwater management, and cross access easements as depicted on CSM #9127 shall be vacated with said vacation being made part of this instrument. BE IT FURTHER RESOLVED, That prior to receipt of City signatures on the Certified Survey Map, all sanitary sewer, water main, stormwater management, and cross access easements required to serve the amended Dreamland Planned Development District, as depicted on the May 25, 2001 submittal, shall be dedicated with said dedication being made part of this instrument. BE IT FURTHER RESOLVED, That prior to receipt of City signatures on the Certified Survey Map, all existing structures shall be properly located on this instrument and shall be labeled "to be removed" 8 BE IT FURTHER RESOLVED, That prior to receipt of City signatures on the Certified Survey Map, all existing private wells and on-site sanitary systems shall be depicted on this instrument and shall be labeled "to be abandoned" BE IT FURTHER RESOLVED, That the cross access easement illustrated to connect to Koso Drive shall be labeled on the CSM as follows: "Cross access easement for benefit of adjoining lands. Upon receipt of notice by the City of Muskego that the Common Council has received a duly acknowledged petition signed by at least 51% of the property owners in Golden County Estates Subdivision, the owner of Parcel 2 shall, at owners expense, design, construct, and maintain in perpetuity, all cross access improvements in accordance with plans and specifications approved by the City Engineer and Public Works Committee." BE IT FURTHER RESOLVED, That the cross access easement illustrated to connect to Koso Drive shall be addressed in the amendment to the Developers Agreement as follows: "The Certified Survey Map depicts a cross access easement between Parcel 2 and Koso Drive (Golden County Estates Subdivision). Said easement shall not be improved for pedestrian or vehicle access purposes unless the City of Muskego Common Council receives a duly acknowledged petition signed by at least 51 YO of the property owners in Golden County Estates Subdivision." We would all be satisfied if the current fence would stay in place. Drainage off the East side of the berm: This continues to be a concern for those residents north of the volleyball court (Koso Drive). We would like some assurance that any runoff from the berm will drain into the retention pond to the north. The berm: We continue to have concerns about the placement of trees, and would like to see them planted at 10-1 5ft intervals versus 20ft. Also, a question arose regarding how many of the trees will be evergreens? We understand that a mixture of both deciduous and evergreens would be the most aesthetically pleasing, however we are concerned about the year-round view. Perhaps having more evergreens would help block our view. The other major concern is the way the berm “dips” and rises again. We all agreed that we would rather have a uniform height that gently falls as you get closer to the northern part of the berm. Also, will the berm extend to the north far enough to block the view of those residents like the Mattefs & Burbachs? Goldencountry Edited 7/24/01 Page 1 of 2 The Outlot closest to our subdivision: There is a major concern that this outlot will eventually be some type of fast-food store like Taco Bell, Wendy’s, etc, where a late-night drive-thru will only add to the amount of traffic, noise, etc. 1s there any guarantee that this outlot will not have a fast-food chain as a tenant? We would all appreciate if these concerns will be considered, and responded to before this project progresses.
