CCR2001072COMMON COUNCIL -CITY OF MUSKEG0 RESOLUTION #72-2001 AMENDED AND REVISED FINAL RESOLUTION AUTHORIZING INSTALLATION OF WATER MAIN IMPROVEMENTS AND LEVYING SPECIAL ASSESSMENTS AGAINST BENEFITED PROPERTY (Woods Road-Kurtze Lane to Bay Lane-Pellmann) WHEREAS, Final Assessment Resolution #23-2000 was adopted on January 25, 2000; and WHEREAS, The Public Utilities Committee, has recommended that the Final Assessment Resolution be amended to reduce the following assessment due to the non-buildable frontage of the pond of 655 ft., plus interest, subject to approval and recording of the final plat for Sarah Estates: Tax Kev No. 2218.990 Original deferred assessment on 1297 ft. $47,016.25 Amended deferred assessment on 642 ft. 23,272.50 WHEREAS, The original deferred assessment of $47,016.25 plus interest in the amount of $5,265.82 for a total of $52,282.07 has been paid in full; and WHEREAS, A refund is due to Glenn and Ruth Pellmann in the amount of $23,743.75 principal plus $2,659.42 interest for a total of $26,403.17 NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Public Utilities Committee, does hereby amend the Final Assessment Resolution #23-2000, to reflect the change noted above subject to approval and recording of the final plat for Sarah Estates. BE IT FURTHER RESOLVED That the Water Utility is hereby directed to issue a refund check to Glenn and Ruth Pellmann in the total amount of $26,403.17 subject to approval and recording of the final plat for Sarah Estates. BE IT FURTHER RESOLVED That all remaining sections of the Final Assessment Resolution #23-2000 shall remain unchanged unless specifically amended by this Resolution.
