CCR2001036COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #36-2001 MANDATORY RAZING ORDER S66 W18771 GEM DRIVE TAX KEY NUMBER 2174-094-001 NOW COMES the City of Muskego, Waukesha County, Wisconsin, by its Common Council and for its Razing Order hereby resolves as follows: 1 That this Resolution is a Razing Order in accordance with 566.0413 of Wisconsin Statutes, for the purposes of the within described resolution and it is also a determination of necessity for that project in accordance with 566.0413 (1) (b), Wisconsin Statutes. 2. That the City of Muskego hereby determines that it is necessary for the public benefit and safety that said building be razed in accordance with Chapter 30 of the Muskego Municipal Code as shown on the map attached hereto, made a part hereof and marked Exhibit "A," 0 3. That the structure has fallen into disrepair and has laid vacant for in excess of two years, and that the vast extent of repairs necessary to said structure would be unreasonable and as such in accordance with 566.0413 (1) (b) the building shall be considered a public nuisance. NOW, THEREFORE, be it resolved by the City of Muskego Common Council, as follows: 1 The Common Council hereby finds that the remaining structures at S66 W18771 Gem Drive are so dilapidated and out of repair as to be dangerous, unsafe, unsanitary or otherwise unfit for human habitation, occupancy or use, and further finds that it would be unreasonable to repair such structures. 2. The Common Council hereby orders the owner(s) of the Site to raze and remove the remaining structure and restore the Site to a developable condition not later than 30 days after the date of service to all holders of an encumbrance of record on the property in accordance with 566.0413 (1) (d). For purposes of this order, "developable condition" shall mean that all walls are taken down and removed, that all concrete flooring, footing and other substructures are broken up and removed, that all resulting demolition materials are removed from the Site, that all excavations are filled with suitable compacted fill and the site is restored to a dust and erosion free condition, in accordance with Chapter 30 of the Municipal Code and Section 66.0413 of the Wisconsin Statutes. 0 a 3. If the owner of the Site fails or refuses timely to complete the demolition of the remaining structure of the site andlor restoration of the Site in accordance with the foregoing order, the Common Council hereby authorizes the City Attorney to commence action in circuit court for a court order to comply in accordance with s66.0413 (1) (9). Upon receipt of said order, the Common Council hereby authorizes the City Building Director to cause such demolition andlor restoration work to be completed after competitively bidding the remaining demolition andlor restoration work in accordance with the requirements of Section 62.15 of the Wisconsin Statutes.
