CCR2000247COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #247-2000 APPROVAL OF PRELIMINARY PLAT The Reserve at Champions Village Subdivision 1 WHEREAS, A preliminary plat for The Reserve at Champions Village Subdivision in the NE X and NW X of Section 25 was submitted on October 13,2000; and WHEREAS, Said plat proposes 17 residential lots and one outlot; and WHEREAS, The Plan Commission has recommended approval of the preliminary plat subject to the conditions of Resolution #P.C. 202-2000, as amended. NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby approve the preliminary plat of The Reserve at Champions Village Subdivision in the NE % and NW % of Section 25 subject to the conditions outlined in amended Resolution #P.C.202- 2000, being met at the time of the final plat. SPONSORED BY: Alderman Kathy Chiaverotti This is to certify that this is a true and accurate copy of Resolution #247-2000 which was adopted by the Common Council of the City of Muskego. 11/2000jmb e AMENDED AND ADOPTED APPROVAL OF A PRELIMINARY PLAT FOR THE RESERVE AT CHAMPIONS 3/OPD, AND DETERMINATION OF SUBSTANTIAL CHANGE TO THE VILLAGES AT MUSKEG0 LAKES PLANED UNIT DEVELOPMENT FOR VILLAGES AT MUSKEG0 LAKES PARTNERSHIP LOCATED IN THE NE % AND NW % OF SECTION 25 (TAX KEY NO 2258.996.002, 2257.016, AND 2257.017) RESOLUTION #P.C. 202A-2000 VILLAGE SUBDIVISION, APPROVAL OF CONCEPTUAL REZONING TO RS- WHEREAS, On October 13, 2000 a preliminary plat was submitted by Jeffrey Barczak for the Reserve at Champions Village Subdivision of a property located in the NE ?A and NW ?A of Section 25, and WHEREAS, Said plat consists of 17 proposed lots and one outlot, and encompasses unplatted lands previously approved by the City of Muskego as Muirfield Village, and lots 16 and 17 of the plat of Champions Village of Country Club Villages, and WHEREAS, Said property is currently zoned A - Agricultural District, and WHEREAS, Said property has been previously approved to be rezoned, subject to recording the final plat of Muirfield Village, to RSA 1 OPD Attached Single Family Residence with Planned Development Overlay District, and Said property is proposed to be zoned RS310PD Suburban Residence District with Planned Development Overlay zoning, requiring a minimum lot size of 12,500 square feet and an average minimum width of 80 feet, and said lots appear to meet said minimum zoning requirements, and WHEREAS, The 2010 Comprehensive Plan depicts this area for medium density residential development with 3.0 to 4.4 dwelling units per net acre, and such land uses and density are in conformance with the approved concept plan of the Villages at Muskego Lakes Planned Development District, and WHEREAS, The preliminary plat proposed this area for medium density residential development with 0.65 dwelling units per net acre, and the proposal represents a substantial change from the approved concept plan of the Villages at Muskego Lakes Planned Development District, and WHEREAS, Said parcels will be serviced by City sewer and water, and WHEREAS, Wetlands are present on the parcel, and are required to be field delineated by the Southeastern Wisconsin Regional Planning Commission and e 0 indicated on~the Preliminary Plat submittal, and a WHEREAS, Floodplain is present on the parcel, and is required to be field delineated by a professional engineer hired by the petitioner, and WHEREAS, The proposed plat will be required to manage stormwater as required by Chapter 34 of the Municipal Code, and the location of stormwater detention within an outlot is recommended by the Plan Commission, and WHEREAS, Soil borings are required to be completed concurrent with preliminary platting, and no boring logs have been provided, and THEREFORE BE IT RESOLVED, That the Plan Commission approves of a 17 lot preliminary plat for the Reserve at Champions Village Subdivision by Villages at Muskego Lakes Partnership, located in the NE % and NW % of Section 25, and will be receptive to the submittal of a final plat. BE IT FURTHER RESOLVED, The wetland delineations and data tables are required to be illustrated on the face of the preliminary plat. BE IT FURTHER RESOLVED, That all stormwater management appurtenances shall be located within outlots to be owned by pro-rata share of the lot owners and all maintenance shall be the responsibility of an incorporated home owners association. Maintenance of all such facilities shall be addressed by a Stormwater Management Plan and Maintenance Agreement to be developed by the Public Works Committee. BE IT FURTHER RESOLVED, That all required utility and vision corner easements be illustrated on the face of the Final Plat(s). BE IT FURTHER RESOLVED, That the Planning Department shall be provided the data tables for the wetland delineations and information logs regarding the soil borings. BE IT FURTHER RESOLVED, That this approval is subject to resolution of technical discrepancies as identified by the reports of the City Planning Director and City Engineers, and payment of all applicable fees required by the Muskego Municipal Code, and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That prior to or concurrent with Final Plat approval, the Subdivider shall enter into a Developers Agreement and shall tender a Letter of Credit for all required improvements. BE IT FURTHER RESOLVED, That the Plan Commission approved of the concept of rezoning the property to RS310PD concurrent with the approval of a Final Plat for Reserve at Champions Village. 0 0 BE IT FURTHER RESOLVED, That the Plan Commission determines that the proposal represents a substantial change from the approved concept of the Villages at Muskego Lakes Planned Unit Development, and recommends that the Common Council call a public hearing to take comment on the proposal. BE IT FURTHER RESOLVED, That all deed restrictions and protective covenants shall be reviewed by the Plan Commission concurrent with the review of the Final Plat(s). BE IT FURTHER RESOLVED, That any part of this Resolution and Preliminary Plat approval that is in conflict with the plan approvals received from the Public Works Committee or Public Utilities Committee shall be reconciled prior to Common Council approval of the Final Plat, or the recommendations of the Plan Commission pertaining to the Preliminary Plat of Reserve at Champions Village shall be null and void. BE IT FURTHER RESOLVED, That a digital file in *.DXF, *,DGN. or *.DWG format shall be provided to the City of Muskego planning Department within 30 days of Common Council approval. If such files are not received the City Planning Director shall direct the preparation of a file in the aforementioned format, and the cost thereof shall be charged to the Developers Deposit account for the Reserve at Champions Village Subdivision.
