RESOLUTION OF NECESSITY
(Park Acquisition)
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WAUKESHA COUNTY,
WISCONSIN, HEREBY RESOLVES AS FOLLOWS:
1, That this Resolution is a resolution of necessity, in accordance with §32.06(1) and
§32.07(2), Wis. Statutes relating to the within-described public improvement project;
2. That it is hereby determined that it is necessary for the City of Muskego to acquire fee
simple title in said property for park purposes;
3. In furtherance of the above stated public purpose, the City of Muskego must acquire fee
simple title to the real estate more specifically described on attached Exhibit “A” and
attached Exhibit “B’ consisting of a legal description and map;
4. That the City of Muskego will acquire, by condemnation in accordance with Chapter 32,
Wis. Statutes, if necessary, the above-described interest in the above described real-estate
from the record owners thereof and from any and all persons or entities who may have a
record interest in said real estate. a That the herein Resolution was passed and adopted by the Common Council of the City of
Muskego this 28th day of November, 2000 by a vote of 7 ayes and 0 nays.

Legal Description
Park Arthur/ Martin Property
Being that part of the Southwest one quarter of the Northeast one quarter of Section 4, all
being in Town 5 North Range 20 East, City of Muskego, Waukesha County, Wisconsin,
bounded and described as follows:
Commencing at the Northwest corner of the Northeast one quarter of Section 4, thence
south along the west line of the Northeast one quarter of Section 4, 1090‘ f, said point being the
place of beginning, hence east along the north line of the South % of the Northeast one quarter
1330’ f, hence south along the east line of the southeast % of the northeast one quarter to a
point 380’+, hence west to a point 836.803, hence south to the north line of the right-of-way line
of Martin Drive, 950’&, hence northwesterly along the north right-of-way line 380’*, hence
westerly along the north right-of-way line to the west line of the property known as MSKC 2173-
990, hence north to a point 120’*, hence west to a point 150’*, hence south to the north line of
the right-of-way of Martin Drive 120’+, hence northwesterly along the north right-of-way line of
Martin Drive to a point 500’f, hence north along the west line of the northeast one quarter of
Section 4 to a point 260’+, said point being the place of beginning. Said lands containing
