CCR2000137COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #137-2000 e FINAL RESOLUTION AUTHORIZING INSTALLATION OF IMPROVEMENTS AND LEVYING OF SPECIAL ASSESSMENTS AGAINST BENEFITED PROPERTY (Movie-PlexlS67 W19491 Tans Drive) WHEREAS, the owners of the property described as follows have requested that the City provide improvements to said property including detention pond, drainage and landscaping improvements: Tax Key No. MSKC 2180.994.001 Address: S67 W19491 Tans Drive Muskego, Wisconsin and WHEREAS, said property owners have executed a Waiver of Special Assessment Notices and Hearings Under §66.60(18), Wisconsin Statutes; and WHEREAS, the property owners have agreed in said waiver that the benefit to said property is equal or greater than the cost thereof. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Muskego as follows: 1 2. 3. The improvements will benefit the above-described property in the City of Muskego and the owners consent to the levying of special assessments against said premises under 566.60, Wisconsin Statutes, for the cost of such an improvement. In accordance with §66.60(18), Wisconsin Statutes, the owners of said property have waived all special assessment notices and hearings required by S66.60, Wisconsin Statutes, and admitted the benefit to their properties from the construction of the improvements. That payment for the improvements is to be made by assessing the cost to the property benefited in the amount of $37,996.25. That assessments represent an exercise of the police power, have been determined on a reasonable basis and are hereby confirmed and have been agreed to by the parties receiving said assessments who have signed a waiver of notice and hearing as to said special assessments. That the assessments due pursuant to this Resolution may be paid in cash in full on or before November 1, 2000, or in fifteen (15) annual installments of principal together with twelve (12) months interest per installment to the Clerk-Treasurer, installment payments to bear interest at the rate of 8% per annum on the unpaid balance commencing on November 1, 2000 and first installment being due on the date when real estate taxes are due and annually thereafter All assessments or installments which are not paid by the date specified shall be extended upon the tax roll as a delinquent tax against the property and all proceedings in relation to the collection, return and sale of property for delinquent real estate taxes shall apply to such special assessment, except as otherwise provided by statute. 5. That the Clerk-Treasurer shall publish this Resolution as a Class 1 Notice in the assessment district and mail a copy of this Resolution and a statement of the final assessment against the benefited property to every property owner whose name appears on the assessment roll whose post office address is known or can with reasonable diligence be ascertained.
