CCR2000106COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #106-2000 APPROVAL OF CERTIFIED SURVEY MAP Loughney WHEREAS, A certified survey map was submitted on March 10, 2000 to finalize a three-parcel land division of the Loughney property located in the SW % of Section 30 on Kelsey Drive; and WHEREAS, The Plan Commission adopted Resolution #P.C. 068-2000 recommending approval. NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby approve the certified survey map to finalize a three-parcel land division of the Loughney property located in the SW X of Section 30 on Kelsey Drive subject to the conditions outlined in Resolution #P.C. 068-2000. BE IT FURTHER RESOLVED That this approval is subject to receipt of all fees required by Section 18.14 of the Land Division Ordinance, any special assessments which may be due, and approval of the City Engineer BE IT FURTHER RESOLVED That approval of said certified survey map is subject to approval of a Subdivider’s Agreement and Letter of Credit and passage and publication of Ordinance #1026. BE IT FURTHER RESOLVED That a DXF or DGN file of this CSM be submitted to the City prior to City signatures being placed upon the certified survey map (3 %” diskette). Kathy Chiaverotti This is t ,o certifv that this is a true and accurate copy of Resolution #106-2000 which was adopted b; the Common Council of the City of Muskego. 5/00jmb RESOLUTION #P.C. 68-2000 APPROVAL OF A THREE (3) LOT CERTIFIED SURVEY MAP FOR THE LOUGHNEY PROPERTY LOCATED IN THE SW % OF SECTION 30 (TAX KEY NO. 2279.993 I KELSEY DRIVE) WHEREAS, On March IO, 2000 a Certified Survey Map was submitted by John Loughney for a three (3) lot land division in the SW % of Section 30, (Tax Key No. 2279.993 I Kelsey Drive), and WHEREAS, The proposed land division would create lots with a minimum area of 2.76 acres and a minimum average width of 256 feet, and WHEREAS, Said property is zoned Agricultural District, requiring a minimum lot size of 2.75 acres and an average minimum width of 300 feet, and WHEREAS, A public hearing has been scheduled for April 11, 2000 before the Common Council to rezone the parcels from A - Agriculture District, to RCE - Residential Country Estate, and WHEREAS, The amended 2005 Comprehensive Plan depicts this area as being set aside for low density rural residential development better described by the requirements of the RCE Residential Country Estate zoning district, and petitioner's proposal meets this goal, and WHEREAS, The 2010 Street System Map illustrates Kelsey Drive to have a 100 ultimate right-of-way width, and the proposal conforms to this Plan, and WHEREAS, Said parcels are proposed to be serviced by municipal sanitary sewer THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a Certified Survey Map for a three (3) lot land division of the Loughney property located in the SW % of Section 30, Tax Key No. 2279.993, subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESLOVED, That a grading plan for the subject lots shall be required. BE IT FURTHER RESOLVED, that a Subdivider's Agreement shall be executed concurrent with final Certified Survey Map approvals in order to address public utility and bike path installation requirements.
