APPROVAL OF INTERGOVERNMENTAL COOPERATION AGREEMENT WITH
THE CITY OF MILWAUKEE
FOR USE OF MUSKEG0 FIREARMS TRAINING FACILITY
WHEREAS, The Emerald Park Landfill Agreement with the Police Department for the
utilization of the Firearms Facility provides for the City of Milwaukee to use the facility
for training purposes, and
WHEREAS, The Police Department has negotiated with the City of Milwaukee for a
$25,000 payment for the use of the facility for a period of ten years, and
WHEREAS, The Finance Committee has recommended approval of an
Intergovernmental Cooperation Agreement with the City of Milwaukee as attached
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby approve
the attached Intergovernmental Cooperation Agreement between the City of Milwaukee
and the City of Muskego for use of the City of Muskego Firearms Training Facility.
BE IT FURTHER RESOLVED that the Police Chief and Clerk-Treasurer are hereby
authorized to execute said Agreement in the name of the City.

INTERGOVERNMENTAL COOPERATION AGREEMENT
(City of Muskego Firearms Training Facility)
Pursuant to the provisions of 5 66.30 of the Wisconsin Statutes, this Agreement is made
and entered into as of this - day of ~ 1999. by and
between rhe CITY OF MILWAUKEE, a Wisconsin municipal corporation, having its principal
place of business at 200 East Wells Street, Milwaukee, Wisconsin 53202, and the CITY OF
MUSKEGO, a Wisconsin municipal corporation, having its principal place of business at
Wl82 S8200 Racine Avenue, Muskego, Wisconsin 53150.
RECITATIONS:
WIIEWAS, The City of Muskego is in the process of constructing a new firing range
for the Muskegr, Police Deparment, which is anticipated to bc completcd and ready for service
in the Fall of 1999: and
WHEREASI. The City of'MiIwaukee is desirous 01 obtaining the right to access and
use of the new Muskego Police Department firing range for recruit shotgun training and
tactical unit training: and
WJXEREAS, The City of Muskego is agreeable to the grant of such right of access and
use to the City of Milwaukee under the term and conditions set forth by this Agreement.
NOW, THEREFORE. In consideration of the following mutual covenants and
conditions, the parties hereto agree as follows:
1 The City of Muskego hereby grants to the City of Milwaukee the right of access
and use of the new Muskego Police Drparment firing range for the purpose set forth in

paragraph 2 of the Agreement. Said right of access and use shall comence as of the date that
the new fKing range is opened, and shall continue for a period of ten (IO) years thereafter,
2. The City of Milwaukee shall be guaranteed access to, and use of, the new
Muskego Police Department fuing range for a mum of twenty-five (25) days per year
(commencing with the date of opening of the firing range) for the purposes of recruit shotgun
training and tactical unit training.
3. In consideration of the foregoing rights of accws and use. the City of
Milwaukee shall make the following payment to the City oflvluskego:
An initial, one-time payment in the amount of Twentyfive Thousand and
00/100ths Dollars ($ZS,OOO.OO), to be paid in full within sixty (60) days
following the date of this Agreement as stated hereinabove.
4. This Agreement may be modified, amended, or extended only by the written
mutual agreement of the parties hereto.
5. This Agreement shall be subject to passage of an appropriate authorizing
resolution by the Common Councils of the City of Milwaukee and the City of Muskego. It
shall be construed, interpreted, and governed in accordance with the laws Of the state of
Wisconsin.
