RESOLUTION OF NECESSITY UNDER 5 32.06 AND
tj 32.07, WIS. STATS., FOR ACQUISITION OF
LAND FOR A COMMUNITY CENTER
THE COMMON COUNCIL OF THE CITY OF MUSKEGO. WAUKESHA COUNTY,
WISCONSIN. HEREBY RESOLVES AS FOLLOWS-

That this Resolution is a resolution of necessity, in accordance with 5 32.06(1) and 6
32.07(2). Wis. Stats.. relating to the within-described public improvement project.
That it is hereby determined that it is necessary for the City of Muskego to construct a
community center in the area of the Quietwood Creek development in the City of
Muskego for the public purpose of providing a public place for the community to use for
municipal, educational, recreational and/or social activities;
That it is also necessary, in the furtherance of the above-stated public purpose. for the City
of Muskego to acquire the fee title to the real estate located at S70 W15781 Janesville
Road in the City of Muskego, Waukesha County, Wisconsin. part of Tax Key Number
2172.997 and part of Tax Key Number 2197.999, more specifically described on attached
Exhibit “1” consisting of a legal description and map
That the City of Muskego will acquire, by condemnation in accordance with Chapter 32,
Wis. Stats., if necessary. the above-described interest in the above described real-estate
from the record owners thereof, who presently are Chester Luedke Rev. Trust. and from
any and all persons or entities who may have a record interest in said real estate.
That the herein Resolution was passed and adopted by the Common Council of the City of
Muskego this & day of November. 1999 by a vote of 7 ayes and 0 nays.

Being all that part of the Southeast 1/4 of Section 3 and the Northeast 114 of Section IO,
all being in Town 5 North, Range 20 East, City of Muskego, Waukesha County,
Wisconsin bounded and described as follows:
Commencing at the northeast comer of Section 10 thence S01°14'09"E, 640 feet more or
along the centerline of said unnamed creek to the south line of Janesville Road (C.T.H.
less to the centerline of an unnamed creek; thence northwesterly 1,581 feet, more or less
"L"). Thence along the south line of Janesville Road (C.T.H. "L") and the arc of a curve
974.82 feet more or less, the center of which lies to the southeast, whose radius is
2,327.32 feet and chord which bean N53"58'02"E, 967.72 feet; thence N65"58'00"E,
644.90 feet along said south line to the east line of the Southeast 1/4 of said Section 3;
thence S00°34'56"E, 855.80 feet along the east line of the Southeast 1/4 of said Section 3
to the northeast comer of said Section 10 and the point of beginning, containing 28.52
acres (1,424,139 square feet) more or less of land.
