RESOLUTION
(Superior Emerald Park Landfill, Inc.)
WHEREAS, SUPERIOR EMERALD PARK LANDFILL, INC., hereinafter referred to as
SEPLI, entered into a contract with the CITY OF MUSKEGO, hereinafter referred to as
CITY, and the SEPLI LANDFILL SITING COMMITTEE, hereinafter referred to as
LOCAL COMMITTEE, commonly known as the INTERIM CONSTRUCTION
AGREEMENT, hereinafter referred to as ICA; and
WHEREAS, The LOCAL COMMITTEE and SEPLI made submittals of their final
arbitration offers to the Waste Facility Siting Board; and
WHEREAS, SEPLl's submittal was in violation of the ICA; and
WHEREAS, SEPLI, through its attorneys, has indicated they feel they are no longer
bound by said contract; and
WHEREAS, The Mayor, in consultation with the CITY'S attorneys, felt it was necessary
in the best interest of the CITY to file legal action against SEPLI to protect the CITY'S
legal rights and said action was filed on or about July 21, 1999.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego hereby ratifies the filing of said legal action and authorizes the Mayor, in
consultation with the CITY'S attorneys, to take whatever action the Mayor deems
necessary to protect the CITY'S contract rights and related rights referred to above.
