APPROVAL OF FINAL OFFER OF SUPERIOR EMERALD
PARK LANDFILL SITING COMMITTEE
WHEREAS Superior Emerald Park Landfill, Inc., ("Superior") applied to the Wisconsin
Department of Natural Resources for approval of an expansion of its landfill located in the City
of Muskego, and
WHEREAS Pursuant to the procedure set forth by the Wisconsin Statutes, Superior notified
the City of Muskego and other municipalities of their right to participate in negotiations and
arbitration concerning the requested expansion, and
WHEREAS The Superior Emerald Park Landfill Siting Committee (the "Committee") was
formed to negotiate with Superior concerning the requested expansion, which Committee is
comprised of members appointed by the City of Muskego, Waukesha County, Racine County,
the City of Franklin and the Town of Norway, and
WHEREAS The Committee and Superior have negotiated for approximately 2 %
years but have not yet reached an agreement on all issues, and Superior has filed a petition
for arbitration with the Wisconsin Waste Facility Siting Board which asks the Board to order
that the Committee and Superior submit to binding arbitration, and
WHEREAS The Waste Facility Siting Board has granted the petition, has ordered arbitration,
and has ordered that the Committee and Superior submit final offers, and
WHEREAS State law requires that the final offer of the Committee must be submitted for
approval by resolution of the governing body of each participating municipality before the final
offer is submitted to the Waste Facility Siting Board.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego
does hereby approve the final offer of the Superior Emerald Park Landfill Siting Committee
regarding the arbitration by the Wisconsin Waste Facility Siting Board of the expansion of the
Superior Emerald Park Landfill in the City of Muskego, which final offer is on file in the Office
of the Clerk-Treasurer after final approval of the Siting Committee.
