CCR19990433/99jmb COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #43-99 APPROVAL OF EXTRACTIVE PERMIT SUPERIOR EMERALD PARK LANDFILL WHEREAS, Superior Emerald Park Landfill submitted an application for an extractive permit; and WHEREAS, The necessary public hearing has been held; and WHEREAS, The Plan Commission has recommended approval to the Common Council contingent upon an interim construction agreement being approved by the Siting Committee and the Common Council, receipt of restoration bond in the amount of $32,180.70, and the other conditions outlined in #P.C. 190-98. as amended. NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby approve of an Extractive Permit for Superior Emerald Park Landfill subject to the conditions outlined by the Plan Commission. AMENDED *** (03-16-99) AMENDED ** (03-02-99) AMENDED (12-01-98) RESOLUTION #P.C. 190-98 APPROVAL OF A CONDITIONAL USE PERMIT FOR AN EXTRACTIVE PERMIT FOR SUPERIOR EMERALD PARK LANDFILL AT THE PROPERTY LOCATED AT W124 SI0629 124 STREET WHEREAS, Conceptual plans were submitted on October 12, 1998, November 3, 1998 and November 6, 1998 by Superior Emerald Park for an Extractive Permit at W124 S10629 124 Street (U.S. HWY 45) and WHEREAS, Said property is currently zoned 1-2 General Industrial and A Agricultural, and the proposed use is a permitted use by conditional grant in both districts, and WHEREAS, The proposed extractive operation would be as follows: activity from 7:OO a.m. and close down at 4:30 p.m. on weekdays *with no Saturday, Sunday or Holiday operation; there will be up to 10 trucks carrying, on average, 20 tons of material at two loads per hour for a total of up to 190 trips in a 9 112 hour day; the removal of an estimated ***377,000 cubic yards of clay, and WHEREAS, The extractive operation. would begin approximately 560 feet west of U.S. HWY 45, extend hrther west approximately another 650 feet, have a north-south dimension of approximately 920 feet, and result in a "25 foot deep pit being approximately **22 feet below the elevation of U.S. HWY 45, and WHEREAS, The intent is to utilize the pit to create a pond area if a currently proposed landfill expansion for the same location is not permitted by approving authorities. THEREFORE BE IT RESOLVED, That the Plan Commission approves a conditional use for an extractive permit in compliance with the site and operation plans submitted October 12, 1998, November 3, 1998, November 6, 1998, and ***March 5,1999 by Superior Emerald park for the Superior Emerald Park property located at W124 SI0629 124 Street (US HWY 45). **THEREFORE BE IT FURTHER.RESOLVED, That approval is contingent upon interim construction agreement being approved by Siting Committee and Common Council. That the road surfaces to maintain a dirt-free and dust-free environment within one hour of the presence of said condition.
